CJYE and CJYE-DR-2 Oakville - Acquisition of assets

1. The Commission approves the application by Trafalgar Broadcasting Limited (Trafalgar), as part of a corporate reorganization, for authority to acquire the assets of the radio programming undertaking CJYE Oakville and its transitional digital radio undertaking CJYE-DR-2, from Whiteoaks Communications Group Limited, the parent company of Trafalgar. Trafalgar also requested broadcasting licences to continue the operation of these undertakings.
2. The Commission did not receive any interventions in connection with this application.
3. The Commission notes that, consistent with Commercial Radio Policy 1998, Public Notice CRTC 1998-41, 30 April 1998, the applicant has not proposed any benefits in connection with this application as control of the undertakings has not changed.
4. The Commission will only issue the licences once the vendor has surrendered the current licences to the Commission.
5. The licence for CJYE will expire on 31 August 2006, and the licence for CJYE-DR-2 will expire on 31 August 2004, the current expiry dates. The licences for CJYE and CJYE-DR-2 will be subject to the same terms and conditions as those in effect under the current licences.
6. In accordance with Implementation of an employment equity policy, Public Notice CRTC 1992-59, 1 September 1992, the Commission encourages the licensee to consider employment equity issues in its hiring practices and in all other aspects of its management of human resources.
