Very low-power English-language specialty FM radio station in Sunshine Valley
|
1.

The Commission approves the application by Sunshine Valley 'FM' Ltd. to operate a very low-power English-language specialty FM radio programming undertaking in Sunshine Valley, British Columbia. The station will operate at 90.1 MHz (channel 211VLP) with an effective radiated power of 1.8 watts.

The station will provide a specialty format with at least 32% of its music drawn from category 3 (special interest music). The station's programming will offer local news and weather, and a variety of music that includes world beat, international, classical, western, jazz and blues. The station will broadcast 52.5 hours of locally produced programming each week, which will consist of community announcements, interviews with persons of interest in the community, a 'problem corner' show and a talk show.

The Commission notes the applicant's statement that Sunshine Valley has no schools, churches or businesses. Furthermore, the mountainous terrain surrounding it prevents residents from receiving any radio services from outside the community. The station will represent the first local radio service in Sunshine Valley and will offer residents an opportunity to communicate with one another in an otherwise isolated community. It will also allow residents to participate in the programming.

The applicant will participate in the Canadian talent development (CTD) plan created by the Canadian Association of Broadcasters (CAB). Under the plan, accepted by the Commission in Contributions by radio stations to Canadian talent development - A new approach, Public Notice CRTC 1995-196, 17 November 1995, licensees serving markets the size of Sunshine Valley are required to contribute, through eligible third parties, a minimum yearly amount of $400 to the development of Canadian talent.

The Commission did not receive any interventions in connection with this application.

The licence will expire 31 August 2007 to coincide with the regional licence expiry date. It will be subject to the conditions set out in New licence form for commercial radio stations, Public Notice CRTC 1999-137, 24 August 1999 and to the conditions set out in the appendix to this decision.

The Commission reminds the applicant that it must comply with all aspects of the Commercial Radio Policy 1998, Public Notice CRTC 1998-41, 30 April 1998 and with the Radio Regulations, 1986.

The Department of Industry (the Department) has advised the Commission that, while this application is conditionally technically acceptable, it will only issue a broadcasting certificate when it has determined that the proposed technical parameters will not create any unacceptable interference with aeronautical NAV/COM services.

The Commission reminds the applicant that, pursuant to section 22(1) of the Broadcasting Act, no licence may be issued until the Department notifies the Commission that its technical requirements have been met, and that a broadcasting certificate will be issued.

Given that the technical parameters approved in this decision are for a very low-power unprotected FM service, the Commission also reminds the applicant that it will have to select another frequency if the Department so requires.

Furthermore, the licence for this undertaking will be issued once the applicant has informed the Commission in writing that it is prepared to commence operations. The undertaking must be operational at the earliest possible date and in any event no later than 24 months from the date of this decision, unless a request for an extension of time is approved by the Commission before 25 August 2005. In order to ensure that such a request is processed in a timely manner, it should be submitted at least 60 days before this date.

In accordance with Implementation of an employment equity policy, Public Notice CRTC 1992-59, 1 September 1992, the Commission encourages the licensee to consider employment equity issues in its hiring practices and in all other aspects of its management of human resources.

Appendix to Broadcasting Decision CRTC 2003-418
|

Conditions of licence
|
|
1. The licence will be subject to the following conditions, as well as to the conditions set out in New licence form for commercial radio stations, Public Notice CRTC 1999-137, 24 August 1999, with the exception of conditions of licence no. 8 and no. 10.

2. The station shall be operated within the Specialty format as defined in A review of certain matters concerning radio,Public Notice CRTC 1995-60, 21 April 1995, as amended from time to time.
|
|
3. The licensee shall ensure that a minimum of 32% of all musical selections broadcast during each broadcast week shall be devoted to selections drawn from category 3 (special interest music).
|
|
4. The licensee shall broadcast, in any broadcast week, no more than 20% hit material as defined in Revised policy on the use of hits by English-language FM radio stations, Public Notice CRTC 1997-42, 23 April 1997.
