FM radio station in Olds

1.

The Commission approves the application by CAB-K Broadcasting Ltd. for a broadcasting licence to operate an English-language FM radio programming undertaking in Olds, Alberta.

The station will operate at 97.7 MHz (channel 249B) with an effective radiated power of 13,000 watts. It will operate in a single-station market as defined in Local programming policy for FM radio - definition of a single-station market, Public Notice CRTC 1993-121, 17 August 1993.
 

Programming

All of the programming broadcast by the new station will be locally produced. The station will offer a country music format. It will showcase local talent and make air time available, during its prime time breakfast show, for live interviews and music features. Local talent will be given preference in playlist selections.

The spoken word programming will include local news, sports and weather as well as farm news and a weekly report by students on school activities. The station will feature public service announcements for local events, seven days a week, and will take part in the Government of Alberta's Emergency Public Warning System, which provides weather warnings.

The applicant stated that it will provide opportunities for high school and college students to develop on-air broadcasting skills.

The applicant plans to offer open-line shows when important local issues arise and stated that it will abide by the Commission's policy regarding open-line programming. Accordingly, the Commission is imposing the following condition of licence:
 

The licensee shall adhere to the Policy regarding open-line programming, Public Notice CRTC 1988-213, 23 December 1988.

 

Canadian talent development

The applicant will participate in the Canadian talent development (CTD) funding plan established by the Canadian Association of Broadcasters (CAB). Under this plan, radio licensees serving markets the size of Olds must contribute an annual minimum of $400 to CTD initiatives through eligible third parties. The applicant made a commitment to exceed that minimum requirement. In accordance with the applicant's commitment, the Commission is imposing the following condition of licence:
 

The licensee shall make direct expenditures in support of Canadian talent development (CTD) as follows:

 

$500 in the first year of operation;
$1,000 in the second year;
$1,500 in the third year;
$2,000 in the fourth year;
$2,500 in the fifth year;
$3,000 in the sixth year; and
$3,500 in the seventh year.

 

These annual contributions include a minimum contribution of $400 to CTD in accordance with the funding plan established by the CAB.

The applicant intends to direct its CTD contributions to the Kiwanis Music Festival, to scholarships for music students, and to talent contests.
 

The interventions

The Commission received 14 interventions in support of this application.
 

Issuance of the licence

The licence will expire 31 August 2009 and will be subject to the conditionsset outin New licence form for commercial radio stations, Public Notice CRTC 1999-137, 24 August 1999, with the exception of condition of licence no. 9, relating to the solicitation of local advertising. That condition does not apply to stations operating in a single-station market. The licence will also be subject to the conditions specified in this decision.

The Department of Industry (the Department) has advised the Commission that, while this application is conditionally technically acceptable, it will only issue a broadcasting certificate when it has determined that the proposed technical parameters will not create any unacceptable interference with aeronautical NAV/COM services.

The Commission reminds the applicant that, pursuant to section 22(1) of the Broadcasting Act, no licence may be issued until the Department notifies the Commission that its technical requirements have been met, and that a broadcasting certificate will be issued.

13.

Furthermore, the licence for this undertaking will be issued once the applicant has informed the Commission in writing that it is prepared to commence operations. The undertaking must be operational at the earliest possible date and in any event no later than 24 months from the date of this decision, unless a request for an extension of time is approved by the Commission before 23 July 2005. In order to ensure that such a request is processed in a timely manner, it should be submitted at least 60 days before this date.
 

Employment equity

14.

In accordance with Implementation of an employment equity policy, Public Notice CRTC 1992-59, 1 September 1992, the Commission encourages the licensee to consider employment equity issues in its hiring practices and in all other aspects of its management of human resources.
