The Commission approves the application by Chippewas of Kettle and Stony Point First Nation, on behalf of a non-profit organization to be incorporated as Point Eagle Radio Inc., for a broadcasting licence to operate an English- and Chippewa/Ojibway-language native Type B FM radio programming undertaking in Kettle Point, Ontario.

The new station will broadcast 126 hours of station-produced programming during each broadcast week, including a minimum of 3 hours in the Chippewa/Ojibway language. At least 2% of the music will be performed or composed by Aboriginal artists.

The spoken word programming will include an open-line program, round table discussions, spirituality teachings, language and cultural lessons as well as news programs from an Aboriginal perspective. The applicant stated that, in order to adhere to the Policy regarding open-line programming, Public Notice CRTC 1988-213, 23 December 1988, it will implement a delay system.

The applicant will promote and develop Aboriginal musical talent by broadcasting traditional Aboriginal music throughout the regular programming and will assist Aboriginal artists in the production, promotion and distribution of CDs.

The station will operate at 107.7 MHz (channel 299A) with an effective radiated power of 420 watts.
|

The Commission did not receive any interventions in connection with this application.
|

The Commission requires that native radio programming undertakings and networks broadcast a Canadian content level of at least 35% for category 2 music. A condition of licence to this effect is set out in the appendix to this decision.

The Commission encourages native radio stations that wish to broadcast wrap-around programming after their daily sign-off to use programming from another native radio station or network.

Consistent with the Commission's Native Broadcasting Policy, Public Notice CRTC 1990-89, 20 September 1990, the licence will be for a Type B native FM radio programming undertaking. The licence will expire 31 August 2009 and will be subject to the conditions specified therein as well as to the conditions set out in the appendix to this decision.

The Department of Industry (the Department) has advised the Commission that, while this application is conditionally technically acceptable, it will only issue a broadcasting certificate when it has determined that the proposed technical parameters will not create any unacceptable interference with aeronautical NAV/COM services.

The Commission reminds the applicant that, pursuant to section 22(1) of the Broadcasting Act, no licence may be issued until the Department notifies the Commission that its technical requirements have been met, and that a broadcasting certificate will be issued.

Furthermore, the licence for this undertaking will be issued once the applicant has satisfied the Commission, with supporting documentation, that the following requirements have been met:

· an eligible Canadian corporation has been incorporated in accordance with the application in all material respects;
|
|
· the applicant has informed the Commission in writing that it is prepared to commence operations. The undertaking must be operational at the earliest possible date and in any event no later than 24 months from the date of this decision, unless a request for an extension of time is approved by the Commission before 3 July 2005 In order to ensure that such a request is processed in a timely manner, it should be submitted at least 60 days before this date.
