The Commission received applications by Medicine Hat Broadcasting Ltd. (Medicine Hat Broadcasting), as part of a corporate reorganization, for authority to acquire the assets of the radio programming undertakings CIBW-FM Drayton Valley, CHBW-FM Rocky Mountain House and its rebroadcaster CHBW-FM-1 Nordegg from Big West Communications Corp. Medicine Hat Broadcasting also requested broadcasting licences to continue the operation of these undertakings.

Medicine Hat Broadcasting is the licensee of CFMY-FM Medicine Hat and is a wholly-owned subsidiary of Jim Pattison Industries Ltd., which in turn is a wholly-owned subsidiary of Jim Pattison Ltd.

The Commission did not receive any interventions in connection with these applications.

The Commission notes that the above transactions have occurred without its prior approval. The Commission reminds the licensee that prior approval is required for any transfer of assets of a licensed undertaking.

The Commission approves the applications by Medicine Hat Broadcasting for authority to acquire the assets of CIBW-FM, CHBW-FM and CHBW-FM-1, and for broadcasting licences to continue the operation of the undertakings.

The Commission will issue the licences once the vendor has surrendered the current licences to the Commission.
|

The licences will expire on 31 August 2007, the current expiry date. They will be subject to the conditions set out in New licence form for commercial radio stations, Public Notice CRTC 1999-137, 24 August 1999. Furthermore, the licensee for both CIBW-FM and CHBW-FM must, by condition of licence, make an annual minimum direct contribution of $400 per station (i.e. $800) over each year of the licence term - the equivalent to the Canadian Association of Broadcasters' Distribution Guidelines for Canadian Talent Development, as set out in Contributions by radio stations to Canadian talent development - A new approach, Public Notice CRTC 1995-196, 17 November 1995 - to the local music festival society involved in the production of an annual week-long festival.

In accordance with Implementation of an employment equity policy, Public Notice CRTC 1992-59, 1 September 1992, the Commission encourages the licensee to consider employment equity issues in its hiring practices and in all other aspects of its management of human resources.
