The Commission approves the application by Fabrique de la Paroisse Sacré-Coeur de Jésus de Crabtree to operate a low-power French-language FM radio station in Crabtree, Quebec that will provide religious programming.

The application
|

The Commission received an application from Fabrique de la Paroisse Sacré-Coeur de Jésus de Crabtree (Paroisse Sacré-Coeur) for a licence to operate a low-power French-language religious FM radio programming undertaking in Crabtree, Quebec.
|

|
Paroisse Sacré-Coeur indicated that the station would broadcast 10 hours per week of religious programming, including religious services.
|
3.
|
The proposed station would operate at 106.5 MHz (channel 293LP) with an effective radiated power of 1 watt.
|

Intervention
|

The Commission received an intervention opposing the Paroisse Sacré-Coeur proposal from Astral Radio inc. (Astral), licensee of CFEI-FM Saint-Hyacinthe.

Astral does not oppose the Paroisse Sacré-Coeur proposal per se, but is opposed to the use of frequency 106.5 MHz by that station. In its intervention, Astral states that it applied to the Commission to increase the power of CFEI-FM Saint-Hyacinthe to 48,000 watts and extend its coverage area, while maintaining the same frequency, 106.5 MHz.

Astral is concerned that the Paroisse Sacré-Coeur proposal would cause interference within the CFEI-FM contour.

The applicant did not respond to Astral's intervention.

The Commission's analysis and determination
|

The Commission notes that the proposed station would operate at 106.5 MHz with an effective radiated power of 1 watt. Given that the proposed frequency is unprotected, Paroisse Sacré-Coeur would be required to change the frequency if the new station caused interference with the CFEI-FM frequency.

The Commission therefore approves the application by Paroisse Sacré-Coeur to operate a new FM religious radio programming undertaking at Crabtree using frequency 106.5 MHz (channel 293LP), with an effective radiated power of 1 watt, to broadcast religious programming.

Issuance of the licence

The licence will expire 31 August 2009 and will be subject to the conditions set out in the appendix to this decision.

The Department of Industry (the Department) has advised the Commission that, while this application is conditionally technically acceptable, it will only issue a broadcasting certificate when it has determined that the proposed technical parameters will not create any unacceptable interference with aeronautical NAV/COM services.

The Commission reminds the licensee that, pursuant to section 22(1) of the Broadcasting Act, no licence may be issued until the Department notifies the Commission that its technical requirements have been met, and that a broadcasting certificate will be issued.

Given that the technical parameters approved in this decision are for a low-power unprotected FM service, the Commission also reminds the licensee that it will have to select another frequency if the Department so requires.

Furthermore, the licence for this undertaking will be issued once the licensee has informed the Commission in writing that it is prepared to commence operations. The undertaking must be operational at the earliest possible date and in any event no later than 24 months from the date of this decision, unless a request for an extension of time is approved by the Commission before 21 January 2005. In order to ensure that such a request is processed in a timely manner, it should be submitted at least 60 days before this date.
