Revised lists of eligible satellite services

The Commission is making minor revisions to its Lists of Eligible Satellite Services. The four lists appended to this public notice supersede the lists appended to Public Notice CRTC 2001-82 dated 13 July 2001.

Withdrawal of The Health Network and change of name for Speedvision

In Decision CRTC 2000-461 dated 24 November 2000, the Commission approved an application by Atlantis Broadcasting Inc. to operate a new English-language Category 1 specialty television service called Health Network Canada. Pursuant to an agreement between Alliance Atlantis Broadcasting Inc. and WebMD International LLC filed with the application, WebMD International agreed to request withdrawal of the U.S. service The Health Network from the Lists of Eligible Satellite Services upon the launch of the Canadian service.

The Commission has been informed that the Canadian service has launched. It has also received a letter from Discovery Health Channel, which now controls the U.S. health service, asking that the The Health Network be withdrawn from the Commission's lists. The Commission has therefore withdrawn The Health Network from its List of Part 2 Eligible Satellite Services (Appendix A), List of Part 3 Eligible Satellite Services (Appendix B) and List of DTH Eligible Satellite Services (Appendix C).

Secondly, the Commission has recently received a letter from Speedvision Network informing it that its U.S. service has changed its name to Speed Channel. Speedvision Network stated in its letter that this is only a change of name and not a change in the programming format of the service. Speed Channel was listed on the Commission's lists under the name Speedvision. The Commission has amended its three aforementioned lists to reflect the change of name from Speedvision to Speed Channel.

Playboy TV is only authorized for distribution at the specific request of a subscriber. Distributors are not permitted to package Playboy TV in such a way that subscribers are obligated to purchase Playboy TV in order to purchase any other programming service. Distributors are required to take measures to fully block the reception of both the audio and video portions of Playboy TV to subscribers that request it not be receivable in their home (in either unscrambled or scrambled analog form).

Authorization for the above-noted services is subject to the following:

- When this list of Part 2 eligible satellite services is replaced by another list of Part 2 eligible satellite services, the only authorized services will be those contained in the most recent list; accordingly, this list supersedes the list dated 13 July 2001 (PN 2001-82).

- In the case of signals received from a licensed SRDU, ASN, the CBC English- and French-language Television Services and foreign satellite services, licensees are required to enter into the necessary contractual arrangements for such carriage.

- Licensees that distribute a PBS signal received at the local head end by terrestrial transmission may distribute one PBS service received from a licensed SRDU. All other licensees may distribute a maximum of two PBS services received from a licensed SRDU. Licensees may not distribute the signal of more than one affiliate of the same commercial U.S. network, received from a licensed SRDU, unless otherwise authorized pursuant to a condition of licence.

- In the case of licensed television programming undertakings offering TVA or CTV programming, a licensee also distributing the signal of a local TVA or CTV affiliate shall delete the duplicate programming from the services received from a licensed SRDU or substitute the local service(s) when the programming is identical.

- Licensees that distribute a PBS signal received at the local head end by terrestrial transmission may distribute one PBS service received from a licensed SRDU. All other licensees may distribute a maximum of two PBS services received from a licensed SRDU. Licensees may not distribute the signal of more than one affiliate of the same commercial U.S. network, received from a licensed SRDU, unless otherwise authorized pursuant to a condition of licence.
