Application by THE BIOGRAPHY CHANNEL (CANADA) CORP. to amend the licence of the national English-language Category 1 specialty television service known as The Biography Channel.

 

The licensee proposes to change the condition of licence relating to its nature of service by adding program categories. Presently, this condition of licence reads as follows:

 

The licensee shall provide a national English-language Category 1 specialty television service consisting of fact-based biographical and related programming.

 

The programming must be drawn exclusively from the following categories, as set out in Schedule I to the Specialty Services Regulations, 1990:

 

2b Long-form documentaries
7c Specials, mini-series, made-for-TV feature films
7d Theatrical feature films aired on TV
12 Interstitials
13 Public service announcements (PSAs)
14 Infomercials, promotional/corporate videos

 

No more than 10% of all programming broadcast during the broadcast week shall be drawn from category 2b, with the exception of programming of a biographical nature.

 

No more than 20% of all programming broadcast during each broadcast week shall be drawn from category 7d.

 

The licensee proposes to add the following program categories as authorized categories of programming to be carried by The Biography Channel:

 

2a Analysis and interpretation
5a Formal education and pre-school
10 Game shows
11 General entertainment and human interest

 

The licensee also proposes the following limitations on categories 5a and 10:

 

No more than 10% of all programming broadcast during the broadcast week shall be drawn from category 5a, with the exception of programming of a biographical nature.

 

No more than 10% of all programming broadcast during the broadcast week shall be drawn from category 10, with the exception of programming of a biographical nature.

 

The licensee confirmed that all programs from categories 2a, 5a, 10 and 11 carried by The Biography Channel will be specifically related to the nature of its service.

The licensee proposes to change the condition of licence relating to its nature of service by adding a program category. Presently, this condition of licence reads as follows:

 

The licensee shall provide a national English-language Category 2 specialty television service consisting of an innovative hybrid of Canadian and US breaking-news coverage, in-depth news analysis and long-form actuality programming.

 

The programming must be drawn exclusively from the following categories, as set out in Schedule I to the Specialty Services Regulations, 1990:

2a Analysis and interpretation
2b Long-form documentary
3 Reporting and actualities
5b Informal education/recreation and leisure
11 General entertainment and human interest

The licensee proposes to add program category 10 (game shows) as an authorized category of programming to be carried by MSNBC.

The licensee proposes to change the condition of licence relating to its nature of service by adding program categories. Presently, this condition of licence reads as follows:

 

The licensee shall provide a national English-language Category 1 specialty television service consisting exclusively of programming related to computing, technology and the Internet.

 

The programming must be drawn exclusively from the following categories, as set out in Schedule I to the Specialty Services Regulations, 1990:

 

1 News
2a Analysis and interpretation
2b Long-form documentaries
3 Reporting and actualities
11 General entertainment & human interest
12 Interstitials
13 Public service announcements (PSAs)
14 Infomercials, promotional/corporate videos

The licensee proposes to add the following program categories as authorized categories of programming to be carried by TechTV Canada:

 

7 All subcategories of drama and comedy
10 Game shows

 

In addition, the licensee proposes that the sum of the programming drawn from category 7 would include a limitation that such programming not exceed more than 10% of total programming on TechTV Canada.

 

The licensee confirmed that all programs from categories 7 and 10 carried by TechTV will be specifically related to the nature of its service.

The licensee states that this change is required as a result of interference from a new U.S. television station operating on channel 49 across the border in the Sault Ste. Marie area.
