Application by FAIRCHILD TELEVISION LTD. to amend the licence of the national ethnicspecialty television service known as Fairchild Television. |

The licensee proposes to add a condition of licence to authorize separate local programming in Vancouver and Toronto consisting of no more than 10% of the broadcast month. |
|
The authorization of separate local programming would provide Fairchild with the opportunity to include local news items, election coverage, fund-raisers, telethons and similar charitable events. |

Charlottetown, Prince Edward Island |
Applications by MARITIME BROADCASTING SYSTEM LIMITED and NEWCAP INC. to amend the licences of radio stations CFCY, CHLQ-FM and CHTN Charlottetown, by adding a condition of licence, pursuant to paragraph 11.1(1) of the Radio Regulations, 1986, to permit the licensees to operate their stations pursuant to a Local management agreement (LMA). |

The Commission will also want to consider, if the proposed condition of licence is approved, whether the term of the LMA should extend to 31 August 2004 (the end of the current licence term), or should terminate at an earlier date. |
|
The Commission also seeks comments as to the continued appropriateness of the LMA, as well as on the competitiveness and the availability of radio voice diversity in the market and for the province of Prince Edward Island. |

Applications by CRAIG BROADCAST SYSTEMS INC. (Craig) requesting authority to effect a change in the ownership structure of: |

Craig and the licensees (3844161 Canada Ltd. and 3850099 Canada Ltd.) signed a Joint Venture Agreement with MTV Networks (MTV), which calls for a corporate reorganization. |
|
The new proposed ownership structure, resulting from the Joint Venture Agreement, would affect the effective control of both licensees, Connect and Music 5. |
|
Pursuant to this agreement MTV, a division of Viacom International Inc., a non-Canadian, has agreed to license the rights to produce, operate and distribute MTV-branded television programming services in Canada based on the MTV Programming Services. Further, MTV has an option to acquire up to 51% of the licensees' shares, or their parent companies. |
|
Consequently, the Commission seeks public comments on the proposed ownership structure, pursuant to the Joint Venture Agreement, and on the potential impact it may have on the programming of the services. |
|
The Commission notes that it has received complaints by CHUM Television and MusiquePlus inc. raising concerns about Craig's compliance with the nature of service definitions of both specialty services. These complaints are being dealt with in a separate process. |
