Société en commandite Télébec

SmartTouch services promotion

1.

The Commission received an application by Société en commandite Télébec (Télébec), dated 23 September 2002 and amended on 24 October 2002, to revise General Tariff item 3.3.18, SmartTouch Services, in order to introduce the Christmas 2002 promotion from 18 November 2002 to 31 December 2002.

As part of this promotion, Télébec proposes to offer basic local residential and business customers that subscribe to one SmartTouch service, from the "Vedette" or the "Complémentaire" service offerings, the option of an additional "Vedette" or "Complémentaire" calling feature, of equal or lesser value, free of charge for one month.

In its application, Télébec also proposed to offer basic local residential and business customers who bought a Sanyo CLT 9935 telephone set financed over a 12-month period, and who subscribed to a "Forfait Éclair", a monthly rebate of $1.50 off the financing rates of the telephone set.

The Commission received no comments with respect to the application.

In Commission approves terms and conditions for local exchange and local payphone competition in the territories of TELUS Communications (Québec) Inc. and Télébec ltée, Order CRTC 2001-761, 3 October 2001 (Order 2001-761), the Commission determined that the terms and conditions for local exchange and local payphone competition that apply in the large incumbent local exchange carrier territories would apply in the territories of TELUS Communications (Québec) Inc. and Télébec. In that order, the Commission also stated that market trials and promotions would be exempted from the application of the imputation test on the condition that sufficient information was provided by the incumbent local exchange carriers to demonstrate that the offering was a legitimate market trial or a promotion of limited duration.

The Commission finds that the proposed promotion is in accordance with Order 2001-761.

The Commission approves Télébec's application.

8.

Télébec is to issue revised tariff pages forthwith reflecting this order to be effective on the date of issuance.
