People's Telephone Company of Forest Inc.

Reference: Tariff Notice 41

Call Answer service

1.

The Commission received an application by People's Telephone Company of Forest Inc. (People's), dated 15 July 2002, to revise General Tariff section 820, Call Answer Service, in order to:

a) increase the monthly Call Answer service rates as follows:

- Residential Basic from $4.95 to $7.00;
- Business Basic from $7.95 to $10.00;
- Enhanced Business Messaging from $9.95 to $14.95; and
- Greeting Only from $7.95 to $8.95;

b) introduce new components to Call Answer Service at the following monthly rates:

- Additional Capacity at $2.95;
- Group Messaging at $16.95;
- Additional mailbox to group messaging at $5.00; and
- Urgent Notification, Personal Operator and Voice to E-mail at $1.95;
c) eliminate the following optional services from its General Tariff:
- Wake Up Service;
- Residential Notification;
- Business Notification;
- Business Transfer;
- Business Enhanced 1;
- Business Enhanced 2;
- Business Basic 1;
- Residence Notification LD;
- Business Notification LD;
- Business Transfer LD;
- Business Enhanced 1 LD;
- Business Enhanced 2 LD;
- Repair Service-form class;
- Business Notification LD with Urgent; and
- Business Notification with Urgent.

The Commission received no comments with respect to the application.

The Commission notes that, in Regulatory framework for the small incumbent telephone companies, Decision CRTC 2001-756, 14 December 2001, it assigned the services in question to the fourth price cap service basket. In that decision, the Commission determined that rates for services in the fourth basket would generally be permitted to increase up to any already approved rate for the same service. The Commission further stated that tariff applications should reference when and where the Commission had already approved the rate for the same service. The Commission also determined that an economic study would be required if any proposed rate increases were greater than an already approved rate.

The Commission finds that the proposed rates for all services except for People's Enhanced Business Messaging, Group Messaging and Additional Mailbox services, were previously approved by the Commission for the same services provided by other companies.

The Commission notes that People's did not provide any references to previous Commission decisions to confirm whether the proposed rates for its Enhanced Business Messaging, Group Messaging and Additional Mailbox services, were previously approved by the Commission. The Commission also notes that People's did not provide any economic study in its application, to support the proposed rates for these services. The Commission notes, however, that it has previously approved rates of $10.95, $11.95 and $3.00, respectively, for the same services.

In light of the above, the Commission approves the rate increases proposed by People's, except for Enhanced Business Messaging, Group Messaging and Additional Mailbox, for which the respective rates of $10.95, $11.95 and $3.00 are approved. The revisions take effect as of the date of this order.

People's is to issue revised tariff pages forthwith to reflect these changes.
