Review and vary of Telecom Order CRTC 2002-366, as amended by Telecom Order CRTC 2002-366-1

In this order, the Commission rescinds Business single-line access service, Telecom Order CRTC 2002-366, 3 September 2002, as amended by Telecom Order 2002-366-1, 9 October 2002 and approves on a conditional basis Aliant Telecom Inc. Tariff Notice 32.

In Business single-line access service, Telecom Order CRTC 2002-366, 3 September 2002 (Order 2002-366), as amended by Telecom Order CRTC 2002-366-1, 9 October 2002 (Order 2002-366-1), the Commission approved the application by Aliant Telecom Inc. (Aliant Telecom) to revise its General Tariff item 205.2, Single-line Access, in order to, among other things, increase the rate for business single-line access service in New Brunswick by $3.00 per access.

In a letter dated 6 September 2002, Aliant Telecom was advised that the rate increase approved in Order 2002-366 did not appear to comply with the pricing constraints for single and multi-line business services set out in Regulatory framework for second price cap period, Telecom Decision CRTC 2002-34, 30 May 2002 (Decision 2002-34). Aliant Telecom was asked to comment on whether the approval granted in Order 2002-366 should be amended to make it conditional on the Commission determining that the pricing constraints would be met, when the rate changes of other Aliant Telecom tariff applications were approved.

By letter dated 9 September 2002, Aliant Telecom agreed that the approval granted in Order 2002-366 should be amended to make it conditional on the Commission determining that the price cap requirements were met. Further, Aliant Telecom stated that these would be met when the changes proposed in TN 20B were considered concurrently with the changes proposed in TN 32.

The Commission notes that the pricing constraints set out in Decision 2002-34 would be met if the rate increase in TN 32 were considered concurrently with the rate changes proposed in TN 20B.

In light of the above, the Commission finds that there is substantial doubt as to the original correctness of Order 2002-366, as amended by Order 2002-366-1.

Accordingly, the Commission rescinds, pursuant to section 62 of the Telecommunications Act, the approval granted in Order 2002-366, as amended by Order 2002-366-1, and approves Aliant Telecom's TN 32 conditional upon the approval of TN 20B.
