Aliant Telecom Inc.
Reference: Tariff notices 5 and 5B

Terms of service and definitions

1.

The Commission received an application by Aliant Telecom Inc. (Aliant Telecom) dated 25 January 2002, and revised on 15 May 2002, to introduce item 100, Definitions, and item 105, Terms of Service in its General Tariff. Aliant Telecom indicated that these definitions and terms of service would consolidate and incorporate definitions and terms of service previously approved for the former regional company tariffs, as follows:

- Island Telecom Inc. General Tariff;
- Maritime Tel & Tel Limited General Tariff;
- NBTel Inc. General Tariff;
- NewTel Communications Inc. General Tariff; and
- Atlantic Provinces Telecommunications Council Regional Services Tariff.

The company stated that the terms of service and definitions would not be removed from the former regional companies' tariffs until such time as all services from the respective tariffs were transferred to the Aliant Telecom General Tariff.

The Commission received no comment with respect to this application.

The Commission approves the definitions as proposed by Aliant Telecom.

However, the Commission finds that the proposed terms of service would impose greater obligations on some customers than currently exist under the terms of service of the former regional companies. Hence, the Commission considers that changes to the proposed terms of service are necessary to better balance the rights and obligations of the company and its customers and to further clarify certain terms.

Accordingly, the Commission approves, with the changes set out below, the terms of service as proposed by Aliant Telecom:

- in item 4.1, delete the wording: The company may charge for unusual expenses associated with meeting the needs of customers with special requests, such as performing maintenance and repair work outside of regular working hours.
- in item 7.4, delete the wording: However, where an applicant or customer clearly presents an abnormal risk of loss, Aliant Telecom may require a deposit or alternative not to exceed six months' charges for all services, including anticipated long distance charges.
- in item 7.7, change "ten month intervals" to "six month intervals".
- in lines four and five of item 13.1, change the words "a directory" to "the next directory".
- in item 14.1, delete the wording: nor any right to continuation of service through any particular Central Office.
- in item 19.1, delete the wording: or whatever is the furthest customer or company record which substantiates the date of the error.
- in item 22.10, delete the wording: Aliant Telecom may restrict access to message toll service from a customer's line for non-payment of charges which are purchased from, or billed on behalf of, other long distance service providers and which are not disputed.

The revisions take effect as of the date of this order. Aliant Telecom is directed to issue revised tariff pages forthwith to reflect these changes.
