Subject: Application by Vidéotron Télécom ltéé against Bell Canada and Bell Nexxia relative to the Provision of Fibre Optic Private Networks

Dear Ms. Scott:

To assist the Commission to dispose of Vidéotron Télécom ltéé (VTL)'s application, noted above, further information from Bell Canada and Bell Nexxia Inc. (Bell Nexxia) is needed.

Accordingly, by 15 November 2002, Bell Canada is requested to respond on behalf of itself and Bell Nexxia to the questions attached hereto, providing copies of its responses to other interested parties. VTL may file comments, strictly limited to dealing with the information contained in Bell Canada's responses, serving a copy on Bell Canada and other interested parties, by 26 November 2002. Bell Canada on behalf of itself and Bell Nexxia, may file its answer to VTL's comments, serving a copy on VTL and other interested parties, by 2 December 2002. Interested parties may file submissions on VTL's comments, serving a copy on other interested parties, by 2 December 2002. VTL may file reply comments, serving a copy on other interested parties, by 11 December 2002.

Where a document is to be filed or served by a specific date, it should be actually received, not merely sent, by that date.

QUESTIONS TO BELL CANADA

  1. Provide a copy of the response by Bell Canada and/or Bell Nexxia to the Request for Proposals (RFP) of 11 December 2001 issued by the Commission scolaire des Patriotes and referenced in VTL's 6 March 2002 Application.
  2. Provide full details of all arrangements entered into by Bell Canada and Bell Nexxia which relate to the RFP, including copies of all contracts.
    a) Identify which services are currently being provided pursuant to these contracts and, if applicable, when the provisioning of service commenced.
    b) For each identified contract, provide a summary table showing the price(s) charged (both before and after tax) under the contract. If the contract includes more than one price element, provide a detailed description of each price element, together with the magnitude of the price element.
  3. Provide block diagrams, accompanied by detailed descriptions, showing all services, service components, facilities, (including but not limited to support structure access, network maintenance, and network surveillance), tariff references, locations, and service providers (including Bell Canada and Bell Nexxia each separately delineated) associated with the provision of service pursuant to the arrangements identified in 2) above.
    a) For each identified service, service component and facility, indicate who is providing the service, service component or facility. To the extent that rights of ownership or other legal interests have been transferred from Bell Canada to Bell Nexxia, or vice-versa, in connection with the services, service components or facilities associated with the arrangements identified in 2) above, indicate the holder of such legal interest prior to and after such transfer.
  4. Identify and describe all Bell Canada services, service components, and facilities (together with tariff references, where relevant) provided by Bell Canada to Bell Nexxia associated with the provision of service pursuant to the arrangements identified in 2) above, including as applicable, specific reference to support structures access, network maintenance and network surveillance.
    a) Provide details, including units of demand and monthly amounts paid by Bell Nexxia to Bell Canada, substantiating that Bell Canada is compliant with National Service Tariff, item 901, Support Structures Service.
  5. In Price Cap Regulation and Related Issues, during cross-examination by counsel for Call-Net, Mr. Gillette indicated that it is generally the case that Bell Nexxia would not serve a customer who only has telecommunications needs in Ontario and Quebec (Transcript paragraphs 11547 - 11550, Volume 7).
    a) With respect to the arrangements identified in 2) above, state whether Bell Canada or Bell Nexxia is the provider of service to the customer. If Bell Nexxia is the provider of service to the customer, provide all rationale associated with why Bell Canada is not the provider of service to the customer.
    b) Under the arrangements identified in 2) above, who is the customer required to make payment to?
  6. Pursuant to the arrangements identified in 2) above, is Bell Nexxia acting as an agent for Bell Canada? Why or why not?
    a) If Bell Nexxia is acting as an agent for Bell Canada, is Bell Canada paying Bell Nexxia a commission for agency services? If yes, what is the amount? If no, why not?
  7. In The Companies(Call-Net)26June01-1007 PC Supplemental it states, "It is important therefore to note that Bell Nexxia does not generally resell Bell Canada's tariffed services." Also, during the oral hearing, Mr Gillette indicated that in over 99 per cent of cases involving Bell Canada tariffed services, Bell Nexxia acts as an agent for Bell Canada rather than engaging in resale (Transcript paragraphs 11608-11614, Volume 7).
    a) Pursuant to the contract(s) identified in 2) above, is Bell Nexxia reselling Bell Canada's tariffed services? If yes, why? If no, why not?
  8. Provide Bell Canada's views, including all supporting rationale, including specific reference to National Service Tariff, Item 901, Support Structures Service, on whether or not the arrangements identified in 2) constitute bundling within the meaning of the Commission's bundling rules.
