Please find enclosed interrogatories in the above noted matter. In view of the fact that the Ontario Sewer and Watermain Construction Association (OSWCA) requested that all telephone and cable system operators be subject to mandatory locate requests pursuant to section 32(b) of the Telecommunications Act, interrogatories are being sent for response to the OSWCA, Bell Canada, registered interested parties (including the Canadian Cable Television Association), and to those Ontario independent carriers who chose not to register as interested parties but whom the OSWCA has sought to bind with the Commission's decision (see attachment).

Responses to these interrogatories are to be filed with the Commission and served on the OSWCA, registered interested parties and the Ontario independent carriers no later than 4 November 2002. Parties may file comment on the responses, serving a copy on the other parties, by 19 November 2002. Parties may file their reply, serving a copy on the other parties, by 29 November 2002.

Where a document is to be filed or served by a specific date, the document must be actually received, and not merely sent, by that date.

  1. When making a locate request, indicate the type of information that OSWCA member companies usually:

    a) Provide to telecommunications and cable operators;
    b) Request from telecommunications and cable operators; and
    c) Receive from telecommunications and cable operators.
  2. List, in order of priority and with supporting rationale, the type of information that OSWCA member companies would require from telecommunications and cable operators to ensure that the information provided in response to a locate request is adequate and provided on a timely basis.
  3. Indicate the level of standardisation of locate requests, within an OSWCA member company, and between OSWCA member companies.
  4. a) Provide the priority levels and corresponding lead times typically used by OSWCA member companies when making a locate request. Provide examples where OSWCA member companies would request these priority levels and corresponding lead times.
    b) Provide the priority levels and corresponding lead times proposed by the Ontario One Call organisation to respond to a locate request;
    c) Where the OSWCA member companies do not follow the priority levels and corresponding lead times of the Ontario One Call organisation, explain why not.
  5. In its reply, the OSWCA indicated its willingness to prepare and circulate a summary of a number of recent locate "incidents" involving Canadian carriers i.e., instances where, in its view, response times were unreasonable or response information was inadequate:
  1. For each of the years 2001 and 2002, provide the number of locate requests made by members of the OSWCA to telecommunications and cable operators;
  2. For each of the years 2001 and 2002, provide the number of instances where telecommunications and cable operators did not respond to locate requests:

    i) within a reasonable response time;
    ii) with adequate response information.
  3. For the year 2002 only, provide a summary of instances where telecommunications and cable operators did not respond to locate requests within a reasonable response time;
  4. For the year 2002 only, using the OSWCA member companies priority levels as categories, indicate the number of instances where telecommunications and cable operators did not respond to a locate request within the OSWCA member companies' priority level response time;
  5. For the year 2002 only, using the Ontario One Call organisation priority levels as categories, indicate the number of instances where telecommunications and cable operators would not have provided a response to a locate request within the Ontario One Call organisation's priority level response time.
  6. For the year 2002 only, provide a summary of instances where telecommunications and cable operators did not provide adequate response information to locate requests.
  6.  In their comments, some of the interested parties indicated that the CISC Business Process Working Group (BPWG), when it received the OSWCA's May 2001 letter, concluded that one call organisations provided locate information. The BPWG also stated that the OSWCA should address its concerns to these organisations. Furthermore, Bell Canada noted that Ontario One Call organisation has various committees reviewing current service levels, initiating process improvements and working on damage prevention strategies. At paragraph 27 of its reply, the OSWCA submitted that Ontario One Call organisation, because of its limitations, is a complement and not a substitute for legal standards for responding to locate requests. Explain why the Ontario One Call organisation would not be able to develop sufficiently enforceable standards for responses to locate requests that would:
  1. Track the status of locate completion by Ontario One Call members;
  2. Provide assurance of an accuracy tolerance for locate markings;
  3. Compel Ontario One Call members to respond within a specific timeframe; and
  4. Compel Ontario One Call members to provide specific and accurate information in response to a locate request.

  7.  Indicate whether the Commission has the authority to impose standard locate requests on cable operators, pursuant either to the Telecommunications Act, the Broadcasting Act or any other Act.
