Re: Call-Net's request to expand process in Regulatory Framework for Second Price Cap Period Telecom Decision CRTC 2002-34, 30 May 2002 - Paragraph 251 - TELUS Tariff Notices 494 and 4182 & The Companies' Updated Access Tandem (AT) Cost Study

In paragraph 251 of Regulatory Framework for Second Price Cap Period, Telecom Decision CRTC 2002-34, 30 May 2002 (Decision 2002-34), the Commission required that the incumbent local exchange carriers (ILECs) file updated cost studies and revised rates for the Access Tandem (AT) service by 17 July 2002. Further to this direction, Telus Communications Inc. (TELUS) filed Tariff Notices 494 and 4182 and Aliant Telecom Inc., Bell Canada, MTS Communications Inc. and Saskatchewan Telecommunications (collectively, the Companies) filed updated AT cost studies and the resulting revised AT rates. The Companies subsequently revised their updated cost studies on 23 July 2002.

By letter dated 19 July 2002, Call-Net Enterprises Inc. (Call-Net) submitted that a more extensive review process involving, among other aspects, intervener interrogatories, was required for the Commission and interveners to meaningfully assess the revised AT costs and to ensure that the final AT rates were appropriately cost-based. Call-Net also requested disclosure of certain information included in the Companies' and TELUS' initial cost submissions for which confidentiality had been claimed by the ILECs. Call-Net recommended the following expanded process for the Commission's assessment of the proposed revised AT rates:

  • Intervener interrogatories be posed to ILECs 30 days following the provision by the ILECs of information pursuant to the Commission's decision regarding Call-Net's request for disclosure.
  • Responses by ILECs to intervener interrogatories be filed 30 days from receipt of interrogatories.
  • Intervener requests for disclosure and further responses to interrogatories be filed 10 days from receipt of interrogatory responses.
  • ILECs' reply to intervener requests for disclosure and further responses be filed 5 days from receipt of requests.
  • Interveners' final comments be filed 30 days following the provision by the ILECs of information filed pursuant to the Commission's decision regarding intervener requests for disclosure and further responses to interrogatories; and
  • ILECs' reply comments filed 15 days following intervener final comments.

In response to Call-Net's request, by letter dated 2 August 2002, TELUS indicated that it was not opposed to an expansion of the process to review AT service rates. TELUS however recommended that a disclosure process for the initial cost submissions should be incorporated into Call-Net's proposed revised procedures.

In view of the circumstances, the procedure established in paragraph 251 of Decision 2002-34 associated with the AT service rate is revised as follows:
