New remote community-based television station

The Commission approves the operation of an English and French-language remote community-based television station to serve Isle Madame.

The Commission received an application by Telile:Isle Madame Community Television Association/Association Télévision Communautaire de l'ÎleMadame (the Association) for a broadcasting licence to operate an English and French-language remote community-based television programming undertaking at Isle Madame.

The Association stated that the new station would air, in each broadcast week, approximately 11 hours 30 minutes of programming that would feature community events, interviews, sports and TV bingo. It indicated that, on average, 5 hours would be original programs andthat all of the programming would be Canadian.

During the first year of operation, 85% of the programming offered by the station each month would be in English and 15% would be in French. The applicant made a commitment to increase the level of French-language programming to 25% in each month, beginning in the second year of operation.

The Association also indicated that the station would broadcast some religious programming and confirmed that it would adhere to the guidelines on ethics regarding solicitation of funds and religious programming practices set out in Religious broadcasting policy, Public Notice CRTC 1993-78, 3 June 1993.

The Congrès mondial acadien 2004 submitted an intervention in support of this application. It considered that the proposed station would provide a valuable communication vehicle for the whole community.

Based on its examination of the application, the Commission is satisfied that it is consistent with all the applicable terms and conditions for remote community-based television stations announced in Policy framework for community-based media, Broadcasting Public Notice CRTC 2002-61, 10 October 2002 (Public Notice 2002-61). Accordingly, the Commission approves the application by the Association for a broadcasting licence to operate an English and French-language remote community-based television programming undertaking at Isle Madame.

The station will operate on channel 10, with an effective radiated power of 450 watts.

In accordance with Public Notice 2002-61, the licensee is relieved by condition of licence from the requirements of sections 10(1) to 10(4) of the Television Broadcasting Regulations, 1987 (the Television Regulations) with regard to the retention of program logs or records.

The Commission nevertheless reminds the licensee that it must retain a clear and intelligible audio-visual recording of all its programming, and furnish such recording, upon request, to the Commission, pursuant to the requirements of sections 10(5) and 10(6) of the Television Regulations.

The Commission encourages the licensee to provide captioning of its programming as well as program description, commensurate with its resources, in order to meet the needs of its viewers with hearing or visual impairment.

Issuance of the licence

The licence will expire 31 August 2009 and will be subject to the conditions specified in the appendix to this decision and in the licence to be issued.

The Commission reminds the licensee that, pursuant to section 22(1) of the Broadcasting Act, no licence may be issued until the Department of Industry notifies the Commission that its technical requirements have been met, and that a broadcasting certificate will be issued.

13.

Furthermore, the licence for this undertaking will be issued once the licensee has informed the Commission in writing that it is prepared to commence operations. The undertaking must be operational at the earliest possible date and in any event no later than 24 months from the date of this decision, unless a request for an extension of time is approved by the Commission before 18 October 2004. In order to ensure that such a request is processed in a timely manner, it should be submitted at least 60 days before this date.

Appendix to Broadcasting Decision CRTC 2002-322

  New remote community-based television programming undertaking at Isle Madame
 

Conditions of licence

  1. The licensee is relieved from the requirements of sections 10(1) to 10(4) of the Television Broadcasting Regulations, 1987 with regard to the retention of program logs or records.
  2. The licensee shall adhere to the guidelines on gender portrayal set out in the Canadian Association of Broadcasters' (CAB) Sex-role portrayal code for television and radio programming, as amended from time to time and approved by the Commission. The application of the foregoing condition of licence will be suspended as long as the licensee remains a member in good standing of the Canadian Broadcast Standards Council (CBSC).
  3. The licensee shall adhere to the provisions of the CAB's Broadcast code for advertising to children, as amended from time to time and approved by the Commission.
  4. The licensee shall adhere to the guidelines on the depiction of violence in television programming set out in the CAB's Voluntary code regarding violence in television programming, as amended from time to time and approved by the Commission. The application of the foregoing condition of licence will be suspended as long as the licensee remains a member in good standing of the CBSC.
