Low-power tourist information service on Confederation Bridge

1.

The Commission approves the application by Jack McGaw Consulting Incorporated for a low-power English- and French-language FM radio station to provide a tourist information service from the Confederation Bridge, Prince Edward Island.

2.

The station will broadcast, on a year-round basis, pre-recorded messages informing drivers using the Confederation Bridge of weather and highway conditions as well as attractions and services in nearby communities.

The station will operate at 93.9 MHz (channel 230LP) with an effective radiated power of 37 watts.

The licence will expire 31 August 2008. The conditions of licence are set out in the appendix to this decision.

The Commission acknowledges the interventions filed in support of this application.

The Department of Industry (the Department) has advised the Commission that, while this application is conditionally technically acceptable, it will only issue a broadcasting certificate when it has determined that the proposed technical parameters will not create any unacceptable interference with aeronautical NAV/COM services.

The Commission reminds the licensee that, pursuant to section 22(1) of the Broadcasting Act, no licence may be issued until the Department notifies the Commission that its technical requirements have been met, and that a broadcasting certificate will be issued.

Furthermore, the licence for this undertaking will only be issued once the licensee has informed the Commission in writing that it is prepared to commence operations. The undertaking must be operational at the earliest possible date, and in any event no later than 24 months from the date of this decision, unless a request for an extension of time is approved by the Commission before 29 July 2004. In order to ensure that such a request is processed in a timely manner, it should be submitted at least 60 days before this date.

Given that the technical parameters approved in this decision are for a low-power unprotected FM service, the Commission also reminds the licensee that it will have to select another frequency if the Department so requires.

Conditions of licence

1. The licensee must use the station solely for the purpose of providing a traveller and tourist advisory service which will integrate current reports of road and environmental conditions on the Bridge from the Bridge Communications Control Centre, weather forecasts, weather bulletins, reports of highway conditions in New Brunswick and Prince Edward Island, other traveller safety information and current information for visitors to New Brunswick and Prince Edward Island including descriptions of attractions, events and heritage, cultural, recreation and commercial sites. Each program element will be updated daily, hourly or as necessary.

2. The licensee shall not broadcast more than six minutes of advertising material per clock hour.

3. The licensee shall not broadcast musical selections, except as incidental background music.
