Licence amendment for Men TV - addition of program categories

Summary

The Commission approves an application to amend the licence for Men TV by adding to the list of program categories that may be broadcast by the service.

The application

The Commission received an application by Groupe TVA inc., on behalf of itself and on behalf of Global Television Network Inc., partners in Men TV General Partnership to amend condition of licence 1(b) for the Men TV speciality service by adding the following program categories to the list of program categories that may be broadcast:

. 7a Ongoing dramatic series
. 7d Theatrical feature films aired on TV
. 7e Animated television programs and films
. 12 Interstitials
. 13 Public service announcements
. 14 Infomercials, promotional and corporate videos.

The applicant submitted that approval of the application would enable it to provide a high quality service to its subscribers and ensure diversity of choices, while still maintaining the overall orientation of Men TV.

Current conditions of licence

Men TV - a new specialty channel, Decision CRTC 2000-464, 14 December 2000, included the following conditions of licence defining the nature of service that Men TV could provide:

Nature of service

1. (a) The licensee shall provide a national English-language Category 1 specialty television service dedicated to men's lifestyle. It will provide programming related to the luxury market, the gourmet market, men's beauty and fitness, the book and music market, outdoor adventures and leisure sports, from a Canadian men's perspective.
(b) The programming must be drawn exclusively from the following categories, as set out in Schedule I to the Specialty Services Regulations, 1990:

. 2a Analysis and interpretation
. 2b Long-form documentary
. 3 Reporting and actualities
. 5b Informal education/recreation and leisure
. 7b Ongoing comedy series (sitcoms)
. 7c Specials, mini-series, made-for-TV films
. 9 Variety
. 10 Game shows
. 11 General entertainment and human interest.

(c) No more than 10% of all programming broadcast during each broadcast week shall be drawn from category 7.

Interventions

The Commission did not receive any interventions in connection with this application.

The Commission's determination

The Commission considers that the addition of programming from categories 7a, 7d and 7e would expand the diversity of drama and comedy programming available on Men TV. It could also provide new opportunities for Canadian programs to be broadcast on the service.

The Commission further considers that paragraphs 1(a) and 1(c) of Men TV's current nature of service conditions of licence set out above would serve to ensure that Men TV maintained its current orientation. All programming broadcast on Men TV must meet the criteria set out in condition of licence 1(a) which stipulates that the service must be dedicated to programming about "men's lifestyle." Furthermore, all programming from category 7 is subject to condition of licence 1(c) which specifies that "no more than 10% of all programming broadcast during each broadcast week shall be drawn from category 7."

The licensee further proposed an amendment to its licence to permit Men TV to broadcast programming from categories 12, 13 and 14. The Commission notes that most specialty services are authorized to broadcast programming from these categories, and sees no reason not to allow such programming to be broadcast by Men TV.

In light of the above, the Commission hereby approves the application to amend condition of licence 1(b) for Men TV to provide as follows:
