New low-power tourist information service at Foam Lake

1.

The Commission approves the application by Shelley Thoen-Chaykoski for a low-power English-language FM radio station at Foam Lake to provide a tourist information service.

2.

The station will broadcast, on a year-round basis, pre-recorded messages informing visitors to the Quill Lakes area about birding, hunting and eco-tourism opportunities.

3.

The station will operate at 99.1 MHz (channel 256LP). The Department of Industry (the Department) has advised that the effective radiated power of the undertaking will be 47 watts rather than the 46 watts that had been proposed by the applicant.

The licence will expire 31 August 2008. The conditions of licence are set out in the appendix to this decision.

The Commission acknowledges the intervention filed in support of this application.

The Department has advised the Commission that, while this application is conditionally technically acceptable, it will only issue a broadcasting certificate when it has determined that the proposed technical parameters will not create any unacceptable interference with aeronautical NAV/COM services.

The Commission reminds the licensee that, pursuant to section 22(1) of the Broadcasting Act, the licence for this undertaking will only be issued once the Department has notified the Commission that its technical requirements have been met, and that a broadcasting certificate will be issued.

Given that the technical paramaters approved in this decision are for a low-power unprotected FM service, the Commission also reminds the licensee that it will have to select another frequency if the Department so requires.

The undertaking must be operational within 24 months of the date of this decision. This period does not of course relieve the licensee of its responsibility to begin operation of the new undertaking at the earliest possible date. The licensee's failure to meet this deadline will cause the authority to become null and void, unless a request for an extension of time is approved by the Commission before 3 June 2004. In order to ensure that such a request is processed in a timely manner, it should be submitted in writing at least 60 days before this date.

New low-power FM radio programming undertaking at Foam Lake

 

Conditions of licence

 

1. The licensee must use the station solely for the purpose of broadcasting pre-recorded messages for visitors to the Quill Lakes area informing them of birding, hunting and eco-tourism opportunities.

 

2. The licensee shall not broadcast any advertising material.

 

3. The licensee shall not broadcast musical selections, except as incidental background music.
