	Exemption order respecting cable systems having fewer than 2,000 subscribers
	Summary
	Effective today, the Commission will exempt from licensing requirements and associated regulations, those cable systems that serve small and rural communities, and have fewer than 2,000 subscribers. The exemption order is attached to this notice as Appendix 1. The order sets out the specific criteria that smaller systems must meet to qualify for exemption. A list of the small systems the Commission believes may meet the exemption criteria is attached as Appendix 2.
	Exempt status will become effective following receipt of an application and upon issuance by the Commission of a decision revoking the broadcasting licence held by the operator of an eligible system wishing to operate under the exemption.
	Background
1.	In May 2001 (Public Notice CRTC 2001-59), the Commission issued for public comment a draft of an order (the draft exemption order) that, it proposed, would exempt from licensing requirements all cable systems having fewer than 2,000 subscribers, subject to certain exemption criteria. The Commission received comments raising a variety of issues concerning the proposed exemption order, and these are addressed below.
	Issues
	Sourcing of U.S. 4+1 Signals
2.	The Canadian Cable Television Association (CCTA), Cancom and Bell ExpressVu all asked the Commission to clarify whether exempt undertakings that do not have off-air access to a set of authorized U.S. 4+1 signals would be permitted to obtain such signals from a non-Canadian satellite provider, as opposed to a licensed satellite relay distribution undertaking (SRDU).
3.	In Public Notice CRTC 2000-10 dated 24 January 2000, the Commission issued revisions to certain exemption orders, including its exemption order respecting master antenna television systems (MATV). Among the exemption criteria listed in that order is the following:
	No service received over-the-air or by satellite or microwave or by optical fibre transmission is distributed over the undertaking, other than a service that the Commission by regulation, condition of licence, or otherwise has authorized the licensee of a cable distribution undertaking serving the area within which the undertaking is situated to distribute on its undertaking, whether or not the licensee is actually distributing the service. The signals distributed by the exempt undertaking need not be identical to those signals distributed by the licensed terrestrial distribution undertaking serving the area, so long as they are signals of affiliates of the same network.
4.	The Commission notes that, under this criterion, exempt MATVs are allowed to obtain and distribute authorized U.S. signals from a non-Canadian source, provided the signals are those of affiliates of the same networks as the U.S. stations whose signals are distributed by the local cable operator, provided as well that the signals either appear on the Revised lists of eligible satellite services (Public Notice CRTC 2001-82), as amended from time to time, or have otherwise been authorized by the Commission. In the Commission's view, as set out in PNs 2000-162 and 2001-59, the small cable systems that are the subject of this exemption order should have similar latitude in determining the source of their U.S. 4+1 television network signals.
5.	Currently, Canadian distributors within the broadcast range of the U.S. 4+1 television network signals receive and distribute the signals off air. Others receive these signals via microwave through the facilities of terrestrial relay distribution network undertakings (TRDNUs). Many of the small cable undertakings that are the focus of the current exemption order are not in a position to receive their U.S. 4+1 signals over the air or via microwave, and must acquire U.S. 4+1 signals from another source. Until now, under the Commission's rules, this source had to be a licensed SRDU. These Canadian SRDUs or their affiliates, however, also own and operate the same DTH satellite distribution undertakings that are in direct competition with small cable operators. The Commission believes that it is both timely and consistent with its broadcasting policy objectives to redress this situation and allow exempt cable undertakings to source their 4+1 U.S. network signals either from licensed SRDUs or from non-Canadian satellite service providers. This approach would recognise the regulatory inequalities arising from the fact that, while certain small cable distributors have over-the-air access to U.S. 4+1 stations, other distributors serving communities well removed from the Canada/U.S. border do not.
6.	The exemption criterion set out in section 8 of the order appended to this notice (the small cable exemption order) reads as follows:
	No service received over-the-air or by satellite or microwave or by optical fibre transmission is distributed over the undertaking, other than a service that the Commission, by regulation or otherwise, has authorized.
7.	This criterion, unaltered from that set out in the draft exemption order, would, for example, allow an exempt cable system to receive and distribute, whether from a licensed SRDU or from a non-Canadian source, those U.S. 4+1 signals that are authorized for distribution in Canada by virtue of their inclusion on the List of Part 3 eligible satellite services, as amended from time to time.
	Provision of French-language services
8.	Some comments expressed concern that the draft exemption order, as proposed, could allow small cable operators to cease the distribution of French-language services. The Commission clarifies in the small cable exemption order that the same carriage obligations for French-language services that have applied to small cable systems in the past remain in place under the exemption criteria. The Commission announced in PN 2001-59 that one of the exemption criteria would relate to the carriage of broadcasting services in the official language of the minority. Exemption Criterion 4 of the small cable exemption order has been modified to reflect the wording adopted in Public Notice CRTC 2001-100 entitled Amendments to the Broadcasting Distribution Regulations to implement recommendations of the CRTC's Report on French-language broadcasting services in a minority environment. The obligation to distribute CBC television signals in each of the official languages is retained in the exemption criterion set out in section 3(b) of the order.
	MATV exemption order
9.	The small cable exemption order could have an impact on the service offerings of certain exempted MATVs. Under the MATV exemption criteria, the services available for distribution by an exempt MATV in any community are essentially defined by, or restricted to, the services that may be distributed by the licensed cable distribution undertaking serving the community. These criteria now need to be modified to reflect the fact that MATVs in smaller markets may operate in service areas where there is an exempt, as opposed to a licensed, cable undertaking. Accordingly, the Commission has today issued a proposal to amend the MATV exemption order to permit an exempt MATV system to distribute the same signals as may be distributed by the cable undertaking, whether licensed or exempt, whose service area encloses that served by the MATV undertaking (Public Notice CTRC 2001-122).
	Potential loss of licensing advantages
10.	The CCTA advised the Commission of the concern of certain small cable system operators that their exemption from licensing requirements might involve a loss of certain advantages associated with holding a licence. As noted in PN 2001-59, exempt undertakings operate as federal undertakings under the authority of the Broadcasting Act. The Commission reminds interested persons that there are many other types of broadcasting undertakings, including MATVs, currently operating under exemption orders issued pursuant to the Act. An undertaking that does not have a licence because it is exempt from licensing requirements remains a broadcasting undertaking subject to federal regulation and supervision. For example, exempt distribution undertakings may still ask the Commission to resolve disputes with Canadian carriers or municipalities under the Telecommunications Act.
	Carriage of the proceedings of the House of Commons
11.	In Public Notice CRTC 2001-115 dated 6 November 2001, the Commission recognized the importance of "ensuring access by all Canadians to the proceedings of the House of Commons and its various committees". Accordingly, the Commission established certain mandatory requirements for the carriage of the House of Commons proceedings and committees by most broadcasting distribution undertakings, including small cable systems. These obligations are echoed in the exemption order. Effective 1 September 2002, an undertaking having a bandwidth of 550 MHz or more must distribute the House of Commons proceedings and its committees, in both official languages. This exemption criterion is set out in section 4(d) of the small cable exemption order.
	Preponderance
12.	The Canadian Association of broadcasters (CAB) suggested that the exemption order should contain a criterion requiring exempt cable systems to distribute a preponderance of Canadian programming in respect of each of analog and digital technology. The Commission, in PN 2001-100, amended subsection 6(2) of the Broadcasting Distribution Regulations to include such a requirement for a preponderance of Canadian programming services with respect to each of analog and digital signal delivery. The wording of this amendment has been repeated as an exemption criterion in section 9(a) of the small cable exemption order.
	Transition
13.	Appendix 2 to this notice lists the undertakings that the Commission believes may be eligible for exemption under this order. However, the Commission's information regarding certain cable systems is incomplete, for example, with respect to such matters as their interconnection with other systems. A system that is not fully interconnected with another broadcasting distribution undertaking would qualify for exemption. Thus, the onus rests with each system operator to confirm that it qualifies for exempt status and make application for revocation of its licence. Unless the licence is revoked, a licensee would remain liable for all obligations associated with its licence (for example, those related to the payment of broadcast licence fees). The Commission would welcome the assistance of associations such as the CCTA and the Canadian Cable Systems Alliance in identifying those undertakings that may qualify for exemption under the small cable exemption order.
14.	The change in licensing status of an undertaking will be effective upon the Commission's issuance of a decision revoking a cable system's broadcasting licence, and will not be issued retroactively. If a small cable system meets the exemption criteria, its operator must, by 15 January 2002, apply to the Commission for revocation of its licence. The Commission will be able to issue decisions on such applications it receives by that date in sufficient time to ensure that the undertakings receive the benefits of the small cable exemption order, for example to ensure that the licence fees that would otherwise have been imposed for the next fiscal year will not apply. Specifically, the fees associated with licensing will cease effective 1 April 2002 for those undertakings that, by the deadline, have declared their eligibility under the exemption and have applied for revocation of their licences. Although the Commission will deal expeditiously with any applications received after that date, it cannot guarantee that it will be able to issue a revocation decision before the licence fees are set.
15.	The Commission reminds parties that any undertaking listed in Appendix 2 and any other small cable system that may be eligible for exemption, but whose operator fails to submit the required application by the 15 January 2002 deadline, may well continue to be subject to licensing requirements, at least for a time. Thus, for example, fees outstanding as of 1 April 2002 will be considered debts owed to the Crown. Such systems will remain ineligible for the benefits of the small cable exemption order; they will continue to be responsible for the payment of fees until the necessary application for revocation of licence is filed and dealt with by the Commission, or until the time of licence renewal. If, at the time of licence renewal, the Commission finds that a system meets the criteria for exemption, the Commission intends not to renew the licence, and the licensee would cease to be subject to future CRTC licence fee assessment. That system, however, will still be liable for any outstanding debts associated with CRTC fees.

	Appendix 1
	Exemption order for small cable undertakings
	The Commission, pursuant to section 9(4) of the Broadcasting Act, by this order, exempts from the requirements of Part II of the Act and any regulations, those persons carrying on broadcasting distribution undertakings of the class defined by the criteria outlined below.
I.	Purpose
	The purpose of these broadcasting distribution undertakings is to serve small and rural communities, and serve fewer than 2,000 subscribers.
II.	Description
	1. The Commission would not be prohibited from licensing the undertaking by virtue of any Act of Parliament or any direction to the Commission by the Governor in Council.
	2. In total, the number of subscribers served by the individual undertaking is fewer than 2,000, the undertaking operates its own head end, and does not serve all or part of the same licensed area as a cable undertaking that is a Class 1 or Class 2 licensee, as defined in the Broadcasting Distribution Regulations.
	Once it becomes exempt, at no time shall an undertaking have more than 2,200 subscribers.
	3. (a) All services of local Canadian television stations and all services of regional television stations, other than affiliates or members of a network of which a local television station is an affiliate or member, are distributed over the undertaking, in each case with no degradation of received signal. In addition, the undertaking shall distribute the programming services referred to above beginning with the "basic band" (as defined in the Broadcasting Distribution Regulations, as amended)of its undertaking.
	(b) If they are not distributed in accordance with section 3(a), the undertaking distributes the programming service of at least one television station owned and operated by the Corporation, in each of the official languages, where the Corporation makes its signals available and pays the costs associated with the transport and reception of its signals at the undertaking's local head end.
	(c) If the undertaking receives programming services that are identical, the undertaking is required to distribute only one of them under section 3(a).
	(d) If the programming services of the two or more regional television stations that are affiliates or members of the same network are received at the local head end, the undertaking is required to distribute only one of them.
	(e) If the undertaking receives over the air an educational television programming service, the operation of which is the responsibility of an educational authority designated by a province other than the province in which the undertaking is located, the undertaking is not required to distribute it under section 3(a), but may distribute it as part of the basic service.
	(f) For the purpose of section 3, the following definitions shall apply:
	"Corporation" means the Canadian Broadcasting Corporation.
	"Educational television programming service" means a television programming service that provides the programming described in the definition of "independent corporation" in section 2 of the Direction to the CRTC (Ineligibility to Hold Broadcasting Licences).
	"Services of local Canadian television stations" in relation to the undertaking, means a television station licensed by the Commission a) that has a Grade A "official contour" (as defined in the Broadcasting Distribution Regulations, as amended) that includes any part of the area served by the undertaking; b) that has, if there is no Grade A official contour, a transmitting antenna that is located within 15 km of the area served by the undertaking.
	"Services of regional television stations" means the services of all television broadcasting stations licensed by the Commission having a Grade B "official contour" (as defined in the Broadcasting Distribution Regulations, as amended) that includes any part of the area served by the undertaking.
	4. (a) An undertaking that has a nominal bandwidth capacity of at least 550 MHz and that delivers any programming service on a digital basis shall distribute in the market:
	(i) at least one French-language Canadian specialty service for every 10 English-language programming services distributed by the undertaking, if the undertaking is operating in a market that is an anglophone market within the meaning of section 18(4)(b) of the Broadcasting Distribution Regulations, as amended; and
	(ii) at least one English-language Canadian specialty service for every 10 French-language programming services distributed by the undertaking, if the undertaking is operating in a market that is a francophone market within the meaning of section 18(4)(a) of the Broadcasting Distribution Regulations, as amended.
	(b) For the purposes of section 4(a)(i), any French-language programming service, other than a service that is required to be distributed pursuant to section 9(1)(h) of the Broadcasting Act or section 3 of theExemption Order, as amended, constitutes a French-language Canadian specialty service.
	(c) For the purposes of section 4(a)(ii), any English-language programming service, other than a service that is required to be distributed pursuant to section 9(1)(h) of the Broadcasting Act or section 3 of the Exemption Order, as amended, constitutes an English-language Canadian specialty service.
	(d) On and after 1 September 2002, an undertaking with a bandwidth capacity of 550 MHz or more must distribute the service that comprises the proceedings of the House of Commons and its committees in both official languages.
	5. The undertaking must not provide a subscriber with any programming services, other than licensed pay-per-view services, licensed video-on-demand services or the programming services of exempt programming undertakings, without also providing the basic service described in section 3.
	6. The undertaking must not alter or delete a programming service in the course of its distribution except
	(a) for the purpose of complying with section 328(1) of the Canada Elections Act;
	(b) for the purpose of deleting a programming service to comply with an order of a court prohibiting the distribution of the service to any part of the licensed area;
	(c) for the purpose of altering a programming service to insert an emergency alert message in accordance with an agreement entered into with the operator of the service or the network responsible for the service;
	(d) for the purpose of preventing the breach of programming or underlying rights of a third party, in accordance with an agreement entered into with the operator of the service or the network responsible for the service; or
	(e) for the purpose of deleting a subsidiary signal, unless the signal is, itself, a programming service or is related to the service being distributed.
	7. (a) The undertaking must not distribute a programming service that the undertaking originates and that contains
	(i) anything that contravenes any law;
	(ii) any abusive comment or abusive pictorial representation that, when taken in context, tends to or is likely to expose an individual or group or class of individuals to hatred or contempt on the basis of race, national or ethnic origin, colour, religion, sex, sexual orientation, age or mental or physical disability;
	(iii) any obscene or profane language or pictorial representation; or
	(iv) any false or misleading news.
	(b) For the purpose of section 7(a)(ii), sexual orientation does not include the orientation towards a sexual act or activity that would constitute an offence under the Criminal Code.
	8. No service received over-the-air or by satellite or microwave or by optical fibre transmission is distributed over the undertaking, other than a service that the Commission, by regulation or otherwise, has authorized.
	9. (a) In respect of each of analog and digital technology, the undertaking shall ensure that a majority of the video and audio channels received by a subscriber are devoted to the distribution of Canadian programming services as defined in the Broadcasting Distribution Regulations.
	(b) For the purpose of this section, each pay television service, television pay-per-view service, and video-on-demand service shall be counted as a single video channel.
	(c) This section does not apply to a broadcasting distribution undertaking that distributes programming services only on the basic band.

	Appendix 2
	Small cable undertakings having fewer than 2,000 subscribers
	The Commission's records indicate that there are 1,583 cable distribution undertakings having fewer than 2,000 subscribers. The operators of these cable systems, as listed below, and those of any others that may qualify for exemption, are asked to apply for revocation of their broadcasting licences.
