Application by 3429873 CANADA INC. to amend the licence of the national specialty television service known as TreeHouse TV.

The licensee proposes to amend condition of licence no. 2 limiting the broadcast of programs offered by the specialty service YTV, as follows:

2.a) Except as provided in subsection (b), in any month, none of the programs broadcast by the licensee shall be broadcast by the specialty service YTV.

2.b) For the period of December 1 to December 31 of each broadcast year, the licensee may broadcast up to a maximum of twenty (20) hours of programming from categories 5a, 7 and 11, featuring a Christmas or Chanukah Theme, and broadcast on YTV.

The applicant states that this amendment will allow it to make more special holiday programming available to pre-school children, during the month of December.

The licensee received Commission approval to broadcast up to 10 hours of such programming in December 2000. It considers that the program strategy was a success and wishes to extend the flexibility indefinitely.

Application by CANAL ÉVASION INC. to amend the licence of the French-language national specialty television service known as "Canal Évasion".

The licensee proposes to change condition of licence 1(b) relating to program categories which currently reads as follows:

Nature of service

1(b) ninety percent of the programming must be drawn from category 5b (Education - Informal) and 10% from category 11 (Human interest), as set out in Schedule I of the Specialty Services Regulations, 1990.

The licensee is requesting the following amendments:

5b Informal education/recreation and leisure
7c Specials, mini-series, made-for-TV feature films
7d Theatrical feature films aired on TV

The licensee has indicated that it would accept the following limitations for the new program categories:

7d 5 % of the broadcast week
8b 5% of the broadcast week

The program categories requested by Canal Évasion are identical to those authorized for Travel TV, an English-language digital specialty service approved on 24 November 2000. The majority shareholder in Travel TV is Bell Globemedia Inc., which is also the majority shareholder in Canal Évasion. Canal Évasion has agreed to all the limitations already imposed on Travel TV.

Reasons for the requested amendment:

Canal Évasion requires flexibility to continue to adhere to its commitments with respect to Canadian content to provide enhanced and diverse programming to its subscribers.

Canal Évasion also points out that the proposed changes may permit it to benefit from the synergies that may result from the operation of Travel TV as well as enabling it to exchange programs and collaborate with its french partner La Chaîne Voyage.

The licensee proposes to relocate its transmitter to the CKWS-TV site, a distance of 3.9 kilometres from the existing site.

The licensee wishes to provide a stronger signal to Kingston and facilitate reception to buildings in the central reception area.

The Commission notes that the proposed change will result in a modest expansion of the approved coverage contours.

The licensee proposes to decreasethe effective radiated power from 74,000 watts to 48,000 watts.

There will be a slight reduction in the coverage area to the west of the station.
