Application submitted by LES CHAÎNES TÉLÉ ASTRAL INC. AND ALLIANCE ATLANTIS COMMUNICATIONS INC. to amend the commitment for the French-language specialty service known as Séries + (formerly Canal Fiction) to spend $900,000 each year to fund original French-language feature-length fiction movies intended for television (movies for television, category 7c).

The licensee is requesting approval to allocate this amount also to other types of original French-language drama programs belonging to category 7c (Specials, mini-series) and to original French-language feature-length fiction movies for theatrical release (category 7d).

Implementation of this more broadly applied commitment by Séries + would require amendments to its conditions of licence 1(c) and 1(d), concerning the nature of the service. The licensee therefore proposes to change two of its conditions of licence relating to the nature of its service which read as follows:

Current conditions of licence

1(c) Except for programs in categories 7c (Specials, mini-series or made-for-TV feature films) and 7d (Feature films, theatrical releases), the Canadian programs broadcast on Canal Fiction must have been copyrighted at least 10 years before the date of broadcast. The program logs must make it possible to identify the dates.

1(d) The Canadian programs in category 7d broadcast on Canal Fiction must have been copyrighted at least 7 years before the date of broadcast. The program logs must make it possible to identify the dates.

Séries + proposes to replace these conditions of licence with the following:

Proposed conditions of licence

1(c) Except for programs in categories 7a (Ongoing dramatic series), 7c (Specials, mini-series, made-for-TV feature films) and 7d (Theatrical feature films), the Canadian programs broadcast on Séries + must have been copyrighted at least 10 years before the date of broadcast. The program logs must make it possible to identify the dates.

1(d) The Canadian programs in category 7d broadcast on Séries + must have been copyrighted at least 7 years before the date of broadcast, unless Séries + has participated in their funding at the production stage. The program logs must make it possible to identify the dates.

The licensee also makes three specific commitments that would apply if the Commission approves this application, as follows:

· All category 7d Canadian French-language feature films for which Séries + has participated in the funding at the production stage will also benefit from a commitment that they will be broadcast by a French-language conventional Canadian broadcaster-private or public, general-interest or educational-with which Séries + will negotiate sharing of exhibition windows at the pre-purchase stage.

· For its full licence term, Séries + commits to devote no more than 75% of the total cumulative amounts allocated in fulfilment of its initial commitment to any single one of the four types of licensed original dramatic programming-movies for television, mini-series, specials or feature films for theatrical release.

· The original language of the Canadian dramatic series (category 7a) to be acquired by Séries + under the provisions of condition of licence 1(c) will be other than French, without exception.

According to the licensee, the objective of this application is to provide more flexibility to Séries + in selecting the Canadian programs it broadcasts, in view of the changes that have taken place in the market over the past three years.

Application by ASTRAL RADIO GROUP INC. to amend the licence of the national specialty television service known as Canal Z.

The licensee proposes to change the condition of licence relating to Canadian content which reads as follows:

2. In each broadcast year, the licensee shall devote to the distribution of Canadian programs not less than 60% of the broadcast day and not less than 50% of the evening broadcast period.

This condition of licence will be replaced by the following condition of licence:

2 a) In the first and second broadcast year, the licensee shall devote to the distribution of Canadian programs not less than 60% of the broadcast day and not less than 50% of the evening broadcast period;

2 b) In each subsequent broadcast year, the licensee shall devote to the distribution of Canadian programs not less than 50% of the broadcast day and not less than 40% of the evening broadcast period;

2 c) In each broadcast year, effective in year three, the licensee shall distribute no less than 104 hours of original first-run Canadian original French-language programs.

The licensee is of the opinion that approval of such an application would enable it to continue to allot average hourly budgets consistent with its original first-run Canadian programs without having to significantly increase the repeat factor for these programs.

In Decision 2000-456, the service was approved as a national Category 1 specialty television service dedicated to programming of specific interest to the gay and lesbian community.

In this Decision, it was stated that the programming must be drawn exclusively from the following categories, as set out in Schedule I to the Specialty Services Regulations, 1990:

Application by WILLIAM EVANOV, on behalf of a company to be incorporated and to be known as CKDX-FM Radio Limited - Newmarket.

The licensee proposes to be relieved from its current condition of licence restricting the broadcasting of hit material to a maximum of 49.9% during each broadcast week.

The licensee proposes to offer a "Dancing oldies" format based upon dance music from the 70's, 80's and disco music. It notes that "the 50% hit factor restriction of music from the 70's severely dilutes the musical presentation of that era. For the format to succeed, CKDX must play the best possible music available".

The licensee is also of the view that "the deletion of its hit condition of licence will not impact any other broadcaster".

Application by GOLDEN WEST BROADCASTING LTD. to amend the licence of its FM radio station at Moose Jaw approved in Decision CRTC 99-473 dated 19 October 1999.

The licensee proposes to move its transmitter approximately 35 kilometres northeast from its original site, to the CFRE-TV site near Disley, and to change the frequency from 93.7 MHz (channel 229C1) to 100.7 MHz (channel 264C).

The licensee has indicated that this proposed change would result in a substancial cost saving.

It is further noted that the proposed change would result in the city of Regina being completely encompassed by the applicant's 3mV/m contour.
