Public Notice CRTC 2001-35

  The Commission has received the following application:

  Application by STAR CHOICE TELEVISION NETWORK INCORPORATED (STAR CHOICE) to amend the condition of licence no. 9 of Star Choice's Direct-to-Home ("DTH") satellite distribution undertaking licence.
  Presently, Star Choice's condition of licence no. 9 reads as follows:
 

"The licensee shall, in each year (i.e. the period from 1 September to the following 31 August), contribute to an existing, independently-administered Canadian program production fund an amount equal to or greater than 5% of the annual gross revenues earned by its broadcasting activities.".

  In particular, Star Choice requests that it be permitted to allocate up to 20% of these funds to certain elements of the Canadian broadcasting system, including the Aboriginal People Television Network ("APTN"), other native broadcasters, francophone broadcasters and distance learning enterprises that require external support.
  In its application, Star Choice states that this licence amendment is required to meet the funding requirements of these groups, which can no longer be satisfied by Canadian Satellite Communications Inc. ("Cancom"), given the limited growth opportunities of Cancom's satellite relay distribution undertaking ("SRDU") operations.
  At the current time, Star Choice contributes 80% of its required contributions to production funds to the Canadian Television Fund. The balance of its required contributions are directed to the Shaw Children's Production Initiative, the Harold Greenberg Fund, and the Canadian Independent Film & Video Production Fund.
  In its application, Star Choice states that the current recipients of contribution from its DTH operations would not be prejudiced in any way by this amendment. Further, Star Choice has committed to continue to allocate 80% of its contributions to Canadian programming to the Canadian Television Fund and will continue to make contributions to the other three production funds that it currently supports. Star Choice is confident that its future contributions to the three funds will remain at their current levels and, in all likelihood, will increase as Star Choice's DTH revenues grow.
