RE: Decision CRTC 2001-238: Restructured bands, revised loop rates and related issues: Revised process schedule regarding the mark-up issue

In paragraph 63 of Decision 2001-238, the Commission set out a process for incumbent local exchange carriers (ILECs) to demonstrate why a mark-up of 15% should not be used in place of 25% to determine loop rates. On 8 June 2001, Bell Canada, Aliant Telecom Inc., MTS Communications Inc., TELUS Communications Inc. and SaskTel filed information pursuant to this process. In view of the extent and nature of the information filed, the schedule for the process regarding the mark-up issue set out in Decision 2000-238 is revised as follows:

  1. Parties may address interrogatories to the ILECs. Any such interrogatories must be filed with the Commission and served on the ILECs in question by 30 July 2001.
  2. Responses to interrogatories addressed to the ILECs are to be filed with the Commission and served on all parties by 31 August 2001.
  3. Requests by parties for further responses to their interrogatories, specifying in each case why a further response is both relevant and necessary, and requests for public disclosure of information for which confidentiality has been claimed, setting out in each case the reasons for disclosure, must be filed with the Commission and served on the party or parties in question by 10 September 2001.
  4. Written responses to requests for further responses to interrogatories and for public disclosure must be filed with the Commission and served on the party or parties making the request by 17 September 2001.
  5. A determination will be issued with respect to requests for further information and public disclosure as soon as possible, and it is expected that any information to be provided pursuant to that determination will be filed with the Commission and served on all parties by 8 October 2001.
  6. All parties may file comments with the Commission, serving a copy on all other parties, by 22 October 2001.
  7. All parties may file reply comments with the Commission, serving a copy on all other parties, by 29 October 2001.

All documents must actually be received, not merely sent, by the date indicated.
