Decision CRTC 2001-80

Ottawa, 16 February 2001

Mr. Mel Cooper
Chairman & CEO
Seacoast Communications Group Inc.
The Mellor Building
825 Broughton St.
Victoria, BC V8W 1E5

Dear Mr. Cooper:

Ref.#: 000914CC588L - Complaint relating to CHTT-FM Victoria, B.C., alleging format change by Rogers Broadcasting Limited - No further regulatory action is required.

In response to our letter dated 23 October 2000, Rogers Broadcasting Limited (Rogers) has responded directly to you in a letter dated 17 November 2000 (copying the Commission) regarding your concerns with respect to programming formats.

Rogers confirmed that it has fully implemented all of the key elements of the 45+ Adult Contemporary format on CIOC-FM. Rogers also explained that it decided to launch the 45+ AC format on CIOC-FM, rather than on CJVI-FM, to avoid disrupting those members of the 45+ age group already listening to CIOC-FM. Consequently, rather than introducing a 45+ AC format on the new CJVI-FM, Rogers chose to implement a Contemporary Hit Format, increasing choice and diversity of radio services for local listeners.

Rogers informed the Commission of these format changes in a letter dated 30 August 2000 (a copy of this letter was given to you by Rogers). Rogers noted that while the Commission no longer regulates the format of FM radio stations, Rogers wished to inform the Commission of the significant increases in the choice and diversity of programming.

In the circumstances, no further regulatory action is required. I note that copies of this correspondence will be placed on Rogers' publicly accessible file for future reference.

Thank you for bringing your concerns to the Commission's attention.

Yours sincerely,

Ursula Menke
Secretary General
