Re: Application 2001-0796-3 by Hometown Cable TV Limited, Scugog Island, Ontario. Delete part of its authorized service area (the subdivisions of Castle Harbour and Honey Harbour Estates in the Township of Scugog)
Application 2001-0784-8 by Compton Cable T.V. Limited, Port Perry/Uxbridge, Ontario. Extend service area to include the subdivisions of Castle Harbour and Honey Harbour Estates in the Township of Scugog and Whitfield Road and Honey's Beach Road.
Dear Mr. Saxe:
We are pleased to inform you that the Commission has approved the aforementioned applications. However, we note that service is already being provided by Compton Cable T.V. Limited to the subdivisions of Castle Harbour and Honey Harbour Estates in the Township of Scugog. We would remind you for the future that any change to the authorized service area of an undertaking requires prior approval by the Commission.
This approval is subject to written receipt from Industry Canada, within 3 months of the date of this decision, that it is prepared to amend the Broadcasting Certificates.
This approval is also subject to the requirement that construction in the extended area be completed and the extended system be in operation within twelve (12) months of the date of this decision or, where the licensee applies to the Commission within this period and satisfies the Commission that it cannot complete the construction and commence operations throughout the extended system before the expiry of this period and that an extension is in the public interest, within such further periods of time as are approved in writing from time to time by the Commission.
Should construction not be completed within the twelve-month period stipulated in this letter or, should the Commission refuse to approve an extension requested by the licensee, the authority granted shall lapse and become null and void upon expiry of the period of time granted herein or upon the termination of the last approved extension period.
The Commission would appreciate being informed of the actual date of implementation of service to the extended area.
All letters of approval issued by the Commission are made available for public examination at the Commission's central office. The Commission also requires you to append this decision and the associated service area map to the licence of the undertakings.
