Increase in power for CIWV-FM Hamilton/Burlington |

Burlingham Communications Inc., licensee of CIWV-FM Hamilton/Burlington submitted an application to amend the broadcasting licence for CIWV-FM by increasing the effective radiated power of that station. The licensee stated that the proposed change will improve CIWV-FM's signal within commercial and high rise buildings in its licensed market, without extending coverage into any new markets. |

An intervention to this application was submitted by CHRW Radio Western 94.7 FM (CHRW), licensee of CHRW-FM London. CHRW contends that CIWV-FM's present operation causes "widespread co-channel interference to CHRW-FM east of London", and that the proposed increase in power would create even more interference. |

The applicant disputes the allegation of interference, and states that there is virtually no overlap between the signal coverage of CIWV-FM and that of CHRW-FM. |

The Commission has considered the views of the applicant and the intervener. It notes that the Department of Industry has advised the Commission that the power increase proposed is technically acceptable, and that CHRW-FM's coverage must be protected only to a radius of 33 kilometres from its transmitter site. |

The Commission is satisfied that the requested power increase for CIWV-FM will improve its primary service to Hamilton/Burlington, and allow CIWV-FM to better compete with the other FM licensees in its market, all of which operate at much higher power levels. The Commission also notes that the change will not in any way preclude CHRW-FM from implementing a change of facilities, including a power increase, on its present frequency, using an engineering proposal that is acceptable to the Department of Industry. |

For the reasons set out above, the Commission approves the application to amend the broadcasting licence for CIWV-FM by increasing the effective radiated power from 1,880 watts to 3,600 watts. |

The Commission authorizes the licensee to operate the undertaking on the basis of the contours and particulars resulting from the above-mentioned change. |

The authority will be effective and the licence will be amended only at such time as the Department of Industry, having advised that the application is conditionally technically acceptable, has determined that there is no unacceptable interference with NAV/COM services and indicated that it will issue a broadcasting certificate (section 22(1) of the Broadcasting Act). |

In addition to the intervention discussed above, the Commission acknowledges and has considered the interventions submitted in support of this application. |
