Licence renewal for CICI-TV, CKNC-TV, CKNY-TV, CHNB-TV, CKNY-TV-11, CITO-TV, CFCL-TV, CHBX-TV and CJIC-TV

1.

The Commission renews the licences for the following television programming undertakings and their transmitters:

· CICI-TV Sudbury and its transmitter CICI-TV-1 Elliot Lake;

· CKNC-TV Sudbury;

· CKNY-TV North Bay;

· CHNB-TV North Bay;

· CKNY-TV-11 Huntsville;

· CITO-TV Timmins and its transmitters CITO-TV-1 Kapuskasing, CITO-TV-2 Kearns, CITO-TV-3 Hearst and CITO-TV-4 Chapleau;

· CFCL-TV Timmins and its transmitters CFCL-TV-1 Kapuskasing, CFCL-TV-2 Kearns, CFCL-TV-3 Hallebourg, and CFCL-TV-4 Chapleau;

· CHBX-TV Sault Ste. Marie and its transmitter CHBX-TV-1 Wawa; and

· CJIC-TV Sault Ste. Marie.

The licences for these undertakings will be subject to the terms, conditions of licence, commitments and expectations set out below, as well as to those contained in Decision CRTC 2001-457. This group of stations, known collectively as MCTV, includes twin-stick operations (co-located CTV and CBC transmitters) at each of Sudbury, North Bay, Timmins, Kearns, Kapuskasing, and Sault Ste. Marie. The CBC- affiliated undertakings are CKNC-TV, CHNB-TV, CFCL-TV, CJIC-TV and their transmitters.

Terms

The licences will be in effect from 1 September 2001 to 31 August 2008.

The Commission notes that this licensee is subject to the Employment Equity Act and therefore files reports concerning employment equity with Human Resources Development Canada.

Conditions of licence

The licensee shall operate each of CKNC-TV, CHNB-TV, CFCL-TV, CJIC-TV and their transmitters as an affiliate of the English-language television network operated by the Canadian Broadcasting Corporation.

With respect to those of its undertakings that broadcast predominantly CTV network programming, the licensee shall, in each broadcast year starting with that beginning 1 September 2003, caption 90% of all programming broadcast during the broadcast day, including 100% of all category 1 - News programming.

7.

With respect to CKNY-TV-11 Huntsville, the licensee may broadcast no more than 6.5% of the commercial availabilities on this station separately from those broadcast on CKNY-TV North Bay, for each hour of station-produced programming broadcast exclusively on the Huntsville station each week.

Expectations and commitments

As noted above, certain of these undertakings operate as affiliates of the CBC television network. As discussed in Decision CRTC 2001-457, and in line with the level of captioned programming currently required of the CBC, the Commission expects the licensee to provide captioning for at least 90% of all programming aired on each of CKNC-TV, CHNB-TV, CFCL-TV, CJIC-TV during the broadcast day, including 100% of all category 1 - News programming.

Until 1 September 2003, the Commission expects the licensee to, at a minimum, maintain the current level of closed captioning on CICI-TV, CKNY-TV, CKNY-TV-11, CITO-TV and CHBX-TV.

The Commission notes the licensee's commitment to provide a minimum combined total of 15.5 hours per week of local programming to the communities served by the MCTV stations.

With respect to CKNY-TV-11 Huntsville, some 14 hours per week of the local programming will originate with CKNY-TV North Bay or with other stations in the MCTV group. The licensee, however, made the further commitment to broadcast approximately one and a half hours per week of separate programming directed to Huntsville.

12.

The licensee confirmed as an additional commitment that the MCTV stations, collectively, will control the allocation of a minimum of $50,000 in development funds that will be made available to independent producers in the local market on an annual basis.
