Re:  Application No. 200105363 - Denied
Request to create new trust arrangement for the shares of CKVU Sub Inc. - Licensee of CKVU-TV - Vancouver

The Commission denies your application of 26 April 2001 for authority to create new trust arrangement, including another trustee, for CKVU-TV. The Commission understands that this would have allowed the parties, CanWest Television Inc. and Global Television Network Inc. on one hand, and CHUM Limited on the other hand, to complete the sale of the shares in CKVU Sub Inc. (CKVU).

The Commission notes that the proposed transaction does not fall within its policy regarding the use of trust arrangements. It is not convinced that the policy should not apply in this case. As a result of this denial, the shares of CKVU are to remain under the current Trust Agreement (approved by letter of authority A00-0152 dated 21 December 2000) in the context of CanWest Global's acquisition of CHAN-TV Vancouver and CHEK-TV Victoria. The Commission notes that the appointed trustee is Mr. L.R. Sherman and that its authority expires on 31 May 2001.

All letters of approval issued by the Commission are made available for public examination at the Commission's central office. The Commission requires you to append this letter to the CKVU-TV licence.
