Transfer of control and shares
- Maritime Broadcasting System Limited, on behalf of CHOY-FM Limitée, requests authority to transfer 49 common shares (49%) of CHOY-FM Limitée, licensee of radio programming undertaking CHOY-FM, serving Moncton, New Brunswick from 2423698 Nova Scotia Limited to Maritime Broadcasting System Limited, wherein they have a voting interest of 87.19%.

The Commission approves the above-noted application for authority to effect a change in the effective control of CHOY-FM Limitée, licensee of radio programming undertaking CHOY-FM, serving Moncton, New Brunswick. The change in effective control of CHOY-FM Limitée was effected through the transfer of 49 common shares (49%) from 2423698 Nova Scotia Limited to Maritime Broadcasting System Limited. Maritime Broadcasting System Limited has a 87.19% voting interest in 2423698 Nova Scotia and is a Canadian controlled company.

The Commission notes that the ownership change occured prior to approval of the Commission. Subsection 11(4) of the Radio Regulations, 1986 states that a licensee must obtain prior approval of the Commission in respect of any transaction that directly or indirectly would result in a change in the effective control of its undertaking or a person owning more than 30 or 50 per cent of the voting interests of a licensee. Consequently, the Commission reminds the licensee that compliance with these Regulations is required at all times.

The Commission will modify its ownership records to reflect the authorized ownership of CHOY-FM Limitée, as shown in the attached appendix.

All letters of approval issued by the Commission are made available for public examination at the Commission's central office. The Commission also requires you to append this letter to your licence.
