26 March 2001 Public Hearing at Montréal

Intra-corporate reorganization

1.

The Commission approves the applications for authority to:

  • transfer the assets of the cable distribution undertaking serving Trois-Rivières from Cogeco Câble Canada inc. to Médiacâble inc.; and

  • transfer the assets of the cable distribution undertaking serving Sainte-Anne-des-Lacs from Médiacâble inc. to Cogeco Câble Laurentides inc.

2.

The Commission will issue Class 3 licences to Médiacâble inc. and Cogeco Câble Laurentides inc., upon surrender of the current licences. Each licence will expire on the current expiry date: 31 August 2001 for the undertaking serving Trois-Rivières and 31 August 2004 for the undertaking serving Sainte-Anne-des-Lacs.

3.

The operation of these undertakings will be regulated pursuant to the Broadcasting Distribution Regulations. The licences will be subject to the condition specified in this decision and to any other condition that may be specified in the licences to be issued.

4.

Médiacâble inc. (which will change its name to Cogeco Câble Trois-Rivières inc.) and Cogeco Câble Laurentides inc. are both subsidiaries of Cogeco Câble inc. These transactions represent an intra-corporate re-organization that does not alter the effective control of the licensees.

5.

The signals that the licensees are authorized to distribute may be received by direct reception, or from any Canadian broadcasting distribution undertaking (licensed or exempted) which is authorized to provide signals to other distributors.

6.

It is a condition of each licence that, for community programming and any other programming of a service that it originates, the licensee adhere to the guidelines on the depiction of violence in television programming set out in the Canadian Association of Broadcasters' Voluntary code regarding violence in television programming, as amended from time to time and approved by the Commission.

7.

The Commission encourages the licensees to consider employment equity issues in its hiring practices and in all other aspects of its management of human resources (Public Notice CRTC 1992-59).
