New FM radio programming undertaking

1.

The Commission approves the application for a broadcasting licence for a French-language FM radio programming undertaking at Saint-Pamphile to serve the regional municipality of l'Islet.

The applicant indicated that the new station will offer an MOR (middle-of-the-road) musical format, complemented by local and regional programming consisting of news, interviews, and cultural activities. The station will also promote local talent.

The new FM station will operate in a single station market. Accordingly, the licensee is exempt from the requirement that, in order to solicit or accept local advertising, one-third of its programming must be local (Public Notice CRTC 1993-121).

Radio La Pocatière Inc., licensee of CHOX-FM La Pocatière, CFEL-FM Montmagny, and Paul Crête, MP for Kamouraska-Rivière-du-Loup-Témiscouata-Les Basques filed interventions opposing this application. CHOX-FM and CFEL-FM argued that they offer local and regional programming that already responds to audience needs in the target area of the new station. As for Paul Crête, he considered that the new station and CHOX-FM could not coexist, given the already small advertising base that they would have to share. Finally, Carat Expert questions the viability of the applicant's business plan since, according to the intervener, advertising revenue projections are highly overestimated.

In reply, the applicant emphasized that the signals of CHOX-FM and CFEL-FM at Saint-Pamphile are of poor quality and reach only a tiny fraction of Saint-Pamphile's population. It also noted that the new station would create long-term employment in the Saint-Pamphile area, would broadcast programming with a local flavour, and would work with the Coopérative musicale de St-Jean-Port-Joli to feature local talent and promote the musical culture of this area.

After reviewing the interventions and the licensee's response, the Commission has decided to approve the application in order to provide a truly local service at Saint-Pamphile. In another decision released today (Decision CRTC 2001-233), the Commission has approved an application by CIBM-FM Mont-Bleu ltée to add a low-power transmitter at Ste-Perpétue. The transmitter will enable listeners in Saint-Pamphile to receive the signal from CHOX-FM La Pocatière more clearly.

The Commission took into consideration the interventions filed in support of this application.

Appendix to Decision
CRTC 2001-234

 

Terms of the licence for the radio programming undertaking at Saint-Pamphile

  The Commission will only issue the licence, and it will only be effective at such time as:
 
  • the licensee confirms in writing that it is ready to begin operation. This must take place within 12 months of today's date. Any request for an extension to that deadline requires Commission approval and must be made in writing within that period;
 
  • the Department of Industry, having advised that the application is conditionally technically acceptable, has determined that there is no unacceptable interference with NAV/COM services and indicated that it will issue a broadcasting certificate (section 22(1) of the Broadcasting Act).
  The licence, when issued, will expire 31 August 2007.
  The station will broadcast on the FM band, on the frequency 94.7 MHz, channel 234LP, with an effective radiated power of 24 watts.
  The technical parameters approved in this decision are for low-power unprotected FM service. The applicant would have to select other frequencies if required to do so to permit the best use of the frequency band.
  The Commission encourages the licensee to consider employment equity issues in its hiring practices and in all other aspects of its management of human resources (see Public Notice CRTC 1992‑59).
 

Conditions of licence

  The licence will be subject to the conditions specified in the licence to be issued, as also set out in Public Notice CRTC 1999‑137.
