General Tariff revisions approved on an interim basis with changes for Novus Telecom Inc.
Tariff Notice 2
This order approves on an interim basis, with the changes outlined below, revisions to Novus Telecom Inc.'s access services tariff for interconnection with interexchange service providers.

1.

Novus filed an application proposing revisions to its General Tariff (CRTC Tariff 21181) in order to comply with Commission's determinations in various decisions and orders on contribution charges and direct connection rates. The proposed revisions included:
a) adding definitions for the terms "central fund administrator", "central fund administration agreement", "class B licensee", "data service", "direct access line" and "interexchange service provider";
b) changing the definitions for "class A licensee", "line-side access", "overseas circuit", "primary interexchange carrier", "resale", reseller", "sharing", "subscriber", and "trunk-side access";
c) replacing the term "interexchange carrier (IXC)" with the term "interexchange service provider (IXSP)"; and

d) amending the contribution provisions and rates.

On 26 July 2000, Bell Canada filed comments on behalf of itself, Island Telecom Inc., Maritime Tel & Tel Limited, MTS Communications Inc., NBTel Inc. and NewTel Communications Inc.

Bell Canada noted that part of the standard definition of "class A licensee" was omitted and that some of the provisions for contribution charges and contribution exemptions require corrections.

The Commission considers that the changes suggested by Bell Canada are appropriate and should be implemented by Novus.

The Commission notes that Novus's tariff also requires amendments to reflect the reduction in the direct connection rates approved in the Commission's letter decision dated 9 March 2000.

As well, Novus should modify its access services tariff for interconnection with wireless service providers (WSPs) to reflect the Commission's determinations in Providing trunk-side access and common channel signalling #7 to wireless service providers, Order CRTC 2000-395, dated 12 May 2000.

The Commission notes that, in addition to the above, several minor corrections to various provisions are required.

Novus filed Tariff Notice 2 on 23 June 2000.

9.

In light of the foregoing, the Commission orders that:
1. The proposed tariffs are approved on an interim basis with the following amendments:
A) amend Item 300, Definitions, as follows:

i) add the following as a new paragraph to the end of the definition of "class A licensee":

Such telecommunications service providers shall have obtained from the Commission a class A licence for the provision of basic international telecommunications services. For more information with respect to licensing requirements refer to the Commission's web site at www.crtc.gc.ca.

ii) add the dialling provisions "1+800/888/877", "101XXX" and "1+950" to the definition of "feature group D service"; and

iii) in the definition of "trunk-side access", replace the dialling provision "1+800/888" with "1+800/888/877" and add the dialling provisions "101XXX" and "1+950".

B) amend Item 301(1) as follows:

i) in sub-item (m), add the phrase", other than the ILEC," immediately after the term "IXSP"; and

ii) in sub-item (n), replace the term "IXSP" with the words "IXC, other than the ILEC,".

C) amend Item 302(1) as follows:

i) in sub-item (a), replace the dialling provision "1+800/888" with "1+800/888/877" and add the dialling provisions "101XXX" and "1+950"; and

ii) in the first sentence in sub-item (b), add the dialling provisions "1+800/888/877", "101XXX" and "1+950".

D) in the table in Item 302(2)(d), replace the direct connection rates with the following:

E) in Item 305(1)(a)(i) and (ii), replace all occurrences of the term "IXSP" with the words "carriers and other service providers".
F) amend Item 305(1)(a) as follows:

i) in sub-item (ii), add the words "(effective January 1, 2000) " to the end of the title of the table;

ii) in the title of the table in sub-item (ii), add the term "ILECs," immediately prior to the words "carriers and other service providers" and add the words "(effective January 1, 2000)" to the end of the title of the table; and

iii) replace note (y) with the following:

"Where applicable, the contribution charges specified above will be attributed to Novus's interexchange traffic where interexchange services are defined by the ILECs' exchange boundaries."

G) in Items 305(2)(a) and (b), add the words "(effective January 1, 2000)" to the end of the titles for the tables.
H) in Item 305(2)(b), amend the rates as follows:

i) for circuit group 40-49, for the province of Alberta, replace with rate of $132 with $133;

ii) for circuit group 50-74, for the province of Alberta, replace the rate of $140 with $141; and

iii) for the circuit group 75-99, for the province of British Columbia, replace the rate of $133 with $134.

I) amend Item 305(3)(a) as follows:
i) replace the words "in Item 305.3(a) and 305.3(b) apply at the domestic end and the contribution rates specified below apply at the international end of any call" with "below apply";

ii) delete the last sentence in paragraph (a);

iii) in the second column of the table, add the words "(effective January 1, 2000)" to the end of the title;

iv) in the title of the third column of the table, add the term "ILECs," immediately prior to the word "carriers" and add the words "(effective January 1, 2000)" to the end of the title; and

v) replace the rates in the third column with the following:

Peak period $0.0066
Off-peak period  $0.0033
J) delete Item 305(3)(b) and renumber the remaining paragraphs as (b), (c) and (d);
K) amend new Item 305(3)(b) as follows:

i) in the first sentence of paragraph (i), replace the word "license" with "licensee";

ii) in paragraphs (i) and (ii), remove the word "applicable" from the phrase "the applicable ILEC's territory";

iii) in sub-item (a) of paragraphs (i) and (ii), add the word "applicable" immediately prior to the term "ILEC"; and

iv) replace the text in paragraph (iii) with the following:

"with respect to contribution-eligible international traffic that the licensee converts from circuit- switched minutes originating in Canada to non-circuit-switched traffic, or from non-circuit- switched traffic to circuit-switched minutes terminating in Canada, the licensee shall a) report to the ILEC all contribution-eligible minutes as measured at the point of conversion to the ILEC in whose territory the conversion occurs, and b) remit to the ILEC the applicable contribution charges as specified in Novus's tariffs"; and

L) in Item 305(4), replace paragraphs (b) and (c) with the following:
"b) The contribution charges specified in Items 305.1, 305.2 and 305.3 above do not apply to:
  • international data traffic; or
  • international voice traffic carried on a facility dedicated to the use of one customer; or
  • international transit traffic that does not connect to the Canadian public switched telephone network (PSTN).
c) An application to the Commission for a contribution exemption with respect to international traffic is not required except in the following instances:
  • where switched domestic traffic is routed through another country on non-dedicated facilities; or
  • where domestic traffic is routed through another country by a licensee but is not controlled by the licensee when it re-enters Canada; or
  • where international traffic is routed through another country to reach an international gateway in another part of Canada.
When any of the above three situations apply, the licensee shall apply to the Commission on a case-by-case basis and provide evidence satisfactory to the Commission that it can accurately track and record contribution-eligible minutes on the facilities in question."
2. Novus is directed to issue forthwith revised tariff pages:

a) reflecting the determinations of Order CRTC 2000-395; and

b) incorporating the changes set out above.
