Contribution exemption for local service approved for TELUS Integrated Communications

The CRTC approves a contribution exemption for a local service provided to TELUS Integrated Communications by Bell Canada.

By letter dated 26 May 2000, TELUS Integrated Communications, a division of TELUS Mobility Cellular Inc., applied for contribution exemption with respect to primary rate interface (PRI) services used to provide local service to end-customers in Ontario. TELUS Integrated provided an affidavit that affirmed that the circuits are used for local resale only, there are no direct private line connections from the PRI circuits to the networks of TELUS Integrated or its affiliates, and it listed the telephone numbers associated with the services in question. The company indicated that the circuits are physically provisioned at various sites corresponding to the location of the customers of TELUS Integrated. It requested that the exemption be effective on the application date 26 May 2000.

By letter dated 13 June 2000, Bell Canada stated that it had reviewed its files and noted that it can confirm that the services listed are provided to TELUS Integrated. Bell Canada also determined that there appear to be a few other services that should also be the subject of the TELUS Integrated request. Bell Canada provided a list of these circuits.

In light of the above, Bell Canada submitted that TELUS Integrated has satisfied the requirements for a contribution exemption with respect to the configuration in question, and accordingly, agreed with the request for exemption, effective the date of application.

The Commission is of the view that TELUS Integrated has provided evidence that satisfies the evidentiary requirements for an exemption and notes that Bell Canada added a few other services that should be covered by the TELUS Integrated request. Further, Bell Canada agrees with TELUS Integrated's request that the exemption be granted on the date of application.

In light of the above, the Commission approves TELUS Integrated's request application effective on the date of application.
