Call-Net Enterprises Inc.

Cross-border Internet traffic

Telecom Order CRTC 99-351, dated 14 April 1999, granted an interim contribution exemption for certain Call-Net Enterprises Inc. cross-border facilities used to carry Internet traffic. Final approval was subject to the provision of a satisfactory technical audit. Call-Net filed the requisite technical audit by letter dated 10 March 2000.

By letter dated 31 March 2000, Bell Canada indicated that it had reviewed the technical audit and noted that it appears to satisfy the Commission's evidentiary requirements. Accordingly, Bell Canada agreed that approval of the exemption should be made final.

The Commission is of the view that Call-Net has filed a satisfactory technical audit that meets its evidentiary requirements. Further, in its letter dated 17 December 1999 concerning the Final Consensus Report of the Industry Task Force on International Contribution Issues, the Commission had removed the requirement for companies to file contribution exemption applications for cross-border circuits.

In light of the foregoing, Call-Net's contribution exemption application is given final approval and applications for such circuits are not required in the future.
