Further process for SaskTel for digital subscriber line service providers' access to unbundled loops and co-location

In Order CRTC 2000-983, dated 27 October 2000, Digital subscriber line service providers' access approved for unbundled loops and co-location, the Commission provided the rationale behind its letter decision of 21 September 2000.

The letter decision directed the incumbent local exchange carriers (ILECs) to give digital subscriber line (DSL) service providers access to unbundled, unloaded loops and co-location, at the same rates, terms and conditions already approved for competitive local exchange carriers (CLECs). Saskatchewan Telecommunications was given an opportunity to comment on the appropriateness of applying this direction to the company.

In its reply of 6 October 2000 to the letter decision, SaskTel submitted, among other things, that on a preliminary basis the direction should apply to the company but identified possible network architecture variations from other telephone companies and requested the right to supplement its preliminary comments following the release of the reasons for the Commission's direction. Order CRTC 2000-983 invited SaskTel to supplement its preliminary comments.

In its submission dated 6 November 2000, SaskTel reiterated its conclusion that it is unaware of any unique circumstances within its market that would cause the Commission to make a different decision for SaskTel than for other ILECs, as it relates to DSL service providers' access to unbundled loops, connecting links and co-location services.

Covad Canada Communications Inc. and Quadrant Newmedia Corp. urged the Commission to apply its letter decision to SaskTel.

Covad further submitted that SaskTel should be directed to unbundle immediately its retail asymmetric digital subscriber line (ADSL) service so that DSL service providers can obtain the various network components of that service on an unbundled basis.

The Commission considers that Covad's request with respect to SaskTel's retail ADSL is outside the scope of this proceeding and finds it inappropriate to give further consideration to it in this proceeding.

The Commission directs SaskTel to issue within 30 days tariff pages and an amended Central Office License Agreement to make unbundled loops, connecting links and co-location services available to DSL service providers under the same terms, rates and conditions which apply to CLECs and other Canadian carriers.
