O.N. Tel - Implementation of toll competition and related matters - Amendment to PN 2000-107

 

Reference: 8622-C12-10/00 and Tariff Notices 57 and 57A

1.

In O.N. Tel - Implementation of toll competition and related matters, Public Notice CRTC 2000-107, dated 20 July 2000 (PN 2000-107), the Commission initiated a proceeding to establish the terms and conditions of toll competition in O.N.Telcom's (formerly O.N. Tel) toll operating territory and to deal with related matters.

In a letter dated 18 September 2000, the PN 2000-107 proceeding was temporarily suspended pending disposition of the issues in the proceeding initiated by Review of contribution collection mechanism and related issues, Telecom Public Notice CRTC 99-6, dated 1 March 1999, (PN 99-6). Parties were advised that a revised schedule would be issued coincident with or shortly after the release of that decision, and that those parties that filed submissions in this proceeding would be given an opportunity to revise them in light of the determinations made in the decision stemming from the proceeding initiated by PN 99-6.

The Commission today issued Changes to the contribution regime, Decision CRTC 2000-745, dated 30 November 2000.

Set out below is the revised procedure for this proceeding. Among the changes are: a) the holding of an oral public hearing, including an opportunity for cross-examination and oral final argument and b) the elimination of one round of written interrogatories given the decision to hold an oral hearing.

 

Revised procedure

5.

Any person who wishes to file only written comments in this proceeding, without receiving copies of the record of this proceeding such as the submissions or interrogatory responses, may do so by writing to the Commission at the address noted in paragraph 22 below, by 27 April 2001.

6.

The Commission has issued today interrogatories to those parties that filed submissions in this proceeding.

7.

Those parties that filed submissions in this proceeding may file with the Commission revised submissions taking into account the findings of Decision 2000-745, serving copies on all other interested parties, by 15 January 2001.

8.

Written responses to interrogatories issued today are to be filed with the Commission and served on all interested parties, by 15 January 2001.

9.

Requests by parties for public disclosure of information for which confidentiality has been claimed in submissions and responses to the Commission interrogatories, setting out in each case the reasons for disclosure, are to be filed with the Commission, and served on all interested parties, by 22 January 2001.

10.

Written responses to requests for public disclosure filed pursuant to paragraph 9 are to be filed with the Commission, and served on all interested parties, by 29 January 2001.

11.

Requests for public disclosure will be dealt with as soon as possible. It is expected that any information to be provided will be filed with the Commission, and served on interested parties, by
6 February 2001.

12.

Interrogatories to any party that filed a submission must be filed with the Commission, and served on the relevant interested party, by 12 February 2001.

13.

Written responses to interrogatories issued pursuant to paragraph 12 are to be filed with the Commission, and served on all interested parties, by 12 March 2001.

14.

Requests by parties for further responses to their interrogatories, specifying in each case why a further response is both relevant and necessary, and requests for public disclosure of information for which confidentiality has been claimed, setting out in each case the reasons for disclosure, are to be filed with the Commission, and served on all interested parties, by 19 March 2001.

15.

Written responses to requests for further information and public disclosure filed pursuant to paragraph 14 are to be filed with the Commission, and served on all interested parties, by 26 March 2001.

Requests for additional information and public disclosure will be dealt with as soon as possible. It is expected that any information to be provided will be filed with the Commission, and served on all interested parties, by 9 April 2001.

 

Oral hearing

An oral public hearing is scheduled to begin at 9:00 a.m., 23 April 2001, at Timmins, Ontario in the Grand Ballroom of the Senator Hotel, 14 Mountjoy St., S. The Commission expects that the hearing will last no longer than five days.

Interested parties wishing to appear at the oral hearing shall file notice of their intention to participate no later than 26 March 2001. Prior to the commencement of the oral hearing, the Commission will issue further directions on procedure with respect to the oral hearing.

19.

In addition to, or instead of, presenting oral final argument, parties may file written final argument with the Commission with a copy served on all other parties by 27 April 2001.

20.

Parties may file reply arguments with the Commission, serving a copy on all parties, by 4 May 2001.

21.

As noted in PN 2000-107, where a document is to be filed or served by a specific date, the document must actually be received, not merely sent, by that date.
