Public Notice CRTC 2000-89

The Commission has received the following applications:
1. ACROSS CANADA
Application (199918182) by CHUM LIMITED and 3661458 CANADA INC., partners in a general partnership to be known as Pulse 24 to amend the broadcasting licence for its national English-language specialty programming undertaking by modifying its current condition of licence 3(a), that refers to national paid or regional paid advertising.
Pulse 24 is currently authorized to distribute up to 12 minutes of advertising material each clock hour, but such material is limited to paid national or regional advertising.
The licensee proposes to alter its existing condition of licence by deleting the references to national or regional advertising. This will allow it to broadcast local advertising as well.
Any such new condition of licence would read as follows: Subject to subsection (b) the licensee shall not distribute during each clock hour more than twelve (12) minutes of advertising material.

2. LÉVIS, Quebec
Application (199811568) by ENTREPRISES RADIO ETCHEMIN INC., licensee of CFOM-FM Lévis. The licensee is requesting that the percentage of vocal music selections of content category 2 that must be devoted to French-language selections by CFOM-FM and broadcast in their entirety between 6 a.m. and 6 p.m. be reduced to 45%.
Section 2.2(10) of the Radio Regulations, 1986 requires that French-language stations devote a minimum level of 65% to these selections.
A condition of licence by which the licensee would be relieved of the regulatory requirement and compelled to respect the 45% level is necessary.
The condition of licence would apply for any broadcast week during which at least 90% of musical selections broadcast from content category 2 are selections released before 1 January 1981.

3. SAULT-AU-MOUTON, SAINT-PAUL-DU-NORD, LES ESCOUMINS, TADOUSSAC, SACRÉ-COEUR AND GRANDES-BERGERONNES, Quebec
Application (200001610) by TÉLÉ-CÂBLE CHARLEVOIX (1977) INC., 300 Viger Avenue East, Montréal, Quebec, H2X 3W4:

a) to delete the condition of licence relieving the licensee from the requirement, found in subsection 32(1)(a) of the Broadcasting Distribution Regulations (the regulations) to distribute the signal of CJBR-TV (SRC) Rimouski. The licensee proposes the distribution of this signal on the basic band; and

b) to be relieved from the requirement found in the same subsection of the regulations to distribute the priority local signal of CFTF-TV-4 (TQS) Forestville, because of the poor reception quality of the signal. It proposes to distribute instead CFJP-TV (TQS) Montréal, received via satellite, on the basic band.

4. NIAGARA-ON-THE-LAKE, Ontario
Application (200004648) by JEANNINE DANCY, doing business under the name of NOTL Info Radio, P.O. Box 1620, Niagara-on-the-Lake, Ontario, L0S 1J0, to amend the broadcasting licence for CHQI-FM Niagara-on-the-Lake by increasing the effective radiated power from 1.3 to 51 watts.
The licensee states that the proposed power increase will enable CHQI-FM:

- to provide programming service along the Niagara Parkway to Queenston, as well as provide 12 local wineries with a listenable signal at their on-site events;

- to deliver Niagara-on-the-Lake information to visitors as they approach the Heritage District from the Queen Elizabeth Way at Glendale and along Route 55 and the Niagara Parkway; and

- to upgrade to a Class A1 FM station having a protected frequency.

The licensee indicates that approval of this application will not change the basic orientation of CHQI-FM, nor will it allow the station to compete or otherwise interfere with the commercial stations in St. Catharines, Niagara Falls and Welland.

5. SUDBURY AND TIMMINS, Ontario
Applications (200014671, 200014689) by REGIONAL CABLESYSTEMS INC., P.O. Box 4500, Sudbury, Ontario, P3A 5W1, proposing to distribute the signal of CITY-TV Toronto on the discretionary tier (and duplicated on the digital service) of its systems serving Sudbury and Timmins, respectively.
When a television station from a distant location is proposed to be carried on a cable system, the Commission considers that the originating station:

- must have no objection to the carriage;

- must not accept local advertising; and

- should enhance the diversity of Canadian programming available in the market.

CHUM Limited, the licensee of CITY-TV, states that it has no objection to the carriage of its station on the Sudbury and Timmins systems; that it will not accept local advertising; and that it will continue to produce local programs about Toronto, thereby not affecting the local programming of broadcasters currently extending into the Sudbury and Timmins markets.
