Revised lists of eligible satellite services | |||
The list of Part 3 eligible satellite services appended to this notice has been amended to reflect a change announced below. The Part 2 list and the list of DTH eligible services are appended for convenience. These three lists supersede the lists appended to Public Notice CRTC 1999-166-1 dated 15 October 1999. | |||
Addition of two Canadian services to the list of Part 3 eligible satellite services | |||

In Public Notices CRTC 1998-111 dated 16 October 1998 and 1999-2 dated 8 January 1999, the Commission called for comments on requests by The Miracle Channel Association (formerly Canada for Christ Broadcasting Association) (CJIL-TV) and Crossroads Television System (CITS-TV - Crossroads), licensees of two religious television services. CJIL-TV and CITS-TV requested that their television services be added to section A of the list of Part 2 eligible satellite services and to the list of Part 3 eligible satellite services. Crossroads also requested that its service be added to the DTH list. | ||

The Commission received a number of interventions in support of these requests. A number of opposing interventions were also filed raising concerns as to whether the addition of the CITS-TV and CJIL-TV services would be in accordance with the Commission's distant Canadian signals policy, as set out in Public Notice CRTC 1993-74. | ||

The Commission's distant Canadian signals policy takes into account the impact that the introduction of distant Canadian signals might have on the revenue base of local broadcasters and on their ability to meet their programming commitments. Since it issued PN 1993-74, the Commission does not add to the list of Part 2 eligible satellite services any distant Canadian service that might have an impact on local broadcasters. This provides local broadcasters in areas served by a Class 1 or a Class 2 broadcasting distribution undertaking with an opportunity to comment on the distribution of a distant Canadian signal in their given markets, whether on a basic or discretionary tier. | ||

Given the potential impact that the introduction of CJIL-TV or CITS-TV might have on local broadcasters, it is the Commission's view that these signals should be subject to its distant Canadian signals policy. It has therefore decided not to add the signals to the list of Part 2 eligible satellite services. As a result, Class 1 and Class 2 licensees wishing to distribute CJIL-TV or CITS-TV will be required to apply to the Commission for authority to distribute either service. | ||

The addition of the CJIL-TV and CITS-TV services to the list of Part 3 eligible satellite services does not raise the same concerns. That list contains satellite services that licensees of Class 3 broadcasting distribution undertakings are authorized to distribute. In areas served by Class 3 undertakings, local broadcasters are generally stations which rebroadcast programming from an originating station located in another city. These rebroadcasting operations would not likely be affected by the introduction of a distant Canadian television station. The Commission has, therefore, decided to add the CJIL-TV and CITS-TV services to the Part 3 list. | ||

With respect to Crossroads' request that its service be added to the DTH list, the Commission notes that section 39(a) of the Broadcasting Distribution Regulations authorizes DTH licensees to distribute the signal of any licensed television programming undertaking. It is therefore not necessary to add CITS-TV to the DTH list. |
