Call for comments - Proposed regulatory amendments for the purpose of implementing certain aspects of the revised policies for campus radio and community radio, and incorporating revised content categories for radio | |
On 28 January 2000, the Commission issued its revised policies for campus and for community radio (see Public Notices CRTC 2000-12 and 2000-13, respectively). On the same date, in Public Notice CRTC 2000-14, the Commission issued revised content categories for radio. In these documents, the Commission noted that implementing certain aspects of the revised policies, and incorporating the revised content categories, would require amendments to the Radio Regulations, 1986. | |
The Commission now seeks comments from the public on the proposed amendments appended to the current notice. | |
Proposed amendments | |

In summary, the amendments would increase the level of Canadian content required of campus and community radio licensees for musical selections in categories 2 and 3; remove certain requirements currently imposed on such licensees regarding the scheduling of this Canadian content; remove similar requirements regarding their scheduling of French-language vocal musical selections; and, as indicated above, incorporate by reference the revised content categories for radio set out in PN 2000-14. |

The Commission invites interested parties to present their comments as to whether the proposed amendments accurately reflect the Commission’s policies as set out in PN 2000-12 and 2000-13. The purpose of this process is to seek comment on the proposed amendments, and not on the issues that were considered in the proceedings from which they emerge. The Commission will accept comments that it receives on or before 25 April 2000. |

The Commission will not formally acknowledge written comments. It will, however, fully consider all comments and they will form part of the public record of the proceeding, provided that the procedures for filing set out below have been followed. |

Interested parties can file their comments on paper or electronically. Submissions longer than five pages should include a summary. |

1. The definitions "content category"1 and "content subcategory"1 in section 2 of the Radio Regulations, 19862 are replaced by the following: | |

2. (1) Subsections 2.2(3)3 and (4)1 of the Regulations are replaced by the following: | |
(3) Except as otherwise provided under a licensee's condition of licence, an A.M. or F.M. licensee licensed to operate a station other than a community or campus station shall, in a broadcast week, devote 10% or more of its musical selections from content category 3 to Canadian selections and schedule them in a reasonable manner throughout each broadcast day. | |

(4) If 7% or more of the musical selections broadcast by a licensee during an ethnic programming period are Canadian selections and are scheduled in a reasonable manner throughout that period, subsections (3), (7) to (9), (15) and (16) shall apply only in respect of the musical selections that are broadcast during the part of the broadcast week that is not devoted to ethnic programs. | |
(2) The portion of subsection 2.2(6)3 of the Regulations before paragraph (a) is replaced by the following: | |
(6) An A.M. or F.M. licensee may, in a broadcast week, reduce the percentage of its Canadian musical selections from content category 2 referred to in subsections (7) to (9) or subsection (15) to | |

(7) Except as otherwise provided under a licensee's condition of licence, and subject to subsection (6), an A.M. or F.M. licensee licensed to operate a station other than a commercial, community or campus station shall, in a broadcast week, devote 30% or more of its musical selections from content category 2 to Canadian selections and schedule them in a reasonable manner throughout each broadcast day. | |
(4) Subsection 2.2(13)3 of the Regulations is replaced by the following: | |
(13) Except as otherwise provided under a licensee's condition of licence, an A.M. or F.M. licensee licensed to operate a station in the French language other than a commercial, community or campus station shall, in a broadcast week, devote 65% or more of its vocal musical selections from content category 2 to musical selections in the French language and schedule them in a reasonable manner throughout each broadcast day. | |

(14) Except as otherwise provided under a licensee's condition of licence, an A.M. or F.M. licensee licensed to operate a community or campus station in the French language shall, in a broadcast week, devote 65% or more of its vocal musical selections from content category 2 to musical selections in the French language. | |
(15) Except as otherwise provided under a licensee's condition of licence, and subject to subsection (6), an A.M. or F.M. licensee licensed to operate a community or campus station shall, in a broadcast week, devote 35% or more of its musical selections from content category 2 to Canadian selections. | |
(16) Except as otherwise provided under a licensee's condition of licence, an A.M. or F.M. licensee licensed to operate a community or campus station shall, in a broadcast week, devote 12% or more of its musical selections from content category 3 to Canadian selections. | |
3. Subparagraph 9(3)(b)(iv)4 of the Regulations is replaced by the following: | |
(iv) any content category 3 musical selection that is described in the appendix to Public Notice CRTC 2000-14 dated January 28, 2000 and entitled Revised Content Categories and Subcategories for Radio, published in the Canada Gazette Part I on February 5, 2000. | |
