Access by Canadian treaty co-productions to funding from certified independent production funds - Call for Comments on a proposed amendment to the eligibility criteria |

Background |

1. |
The Broadcasting Distribution Regulations set out requirements for contributions by licensees to local expression and to Canadian programming. They stipulate that Class 1 and Class 2 licensees, and licensees of direct-to-home satellite distribution undertakings, may direct up to 20% of their required Canadian programming contributions to one or more independently-administered production funds. |

In order to qualify as "independently-administered", production funds must meet the criteria set out in Public Notices CRTC 1997-98 and 1999-29. One of the criteria identified in PN 1997-98 is that productions receiving funding must generally earn at least eight out of ten points related to various key creative program elements. |

Treaty co-productions are programs produced under treaties between Canada and other countries. They are not subject to the eight-out-of-ten point requirement. Instead, under an amendment announced by the Commission in Public Notice CRTC 1996-51, Canadian treaty co-productions approved as such by Telefilm Canada may qualify for access to funding provided 65% or more of their financing is by a Canadian company (the 65% financing requirement). |

In July of this year, the Commission received a letter on behalf of the Independent Production Fund, the Bell Broadcast and New Media Fund, and the Cogeco Program Development Fund. The letter contains a proposal that the Commission amend the criteria related to Canadian treaty co-productions by removing the 65% financing requirement. To qualify for access to funding under this proposal, a Canadian treaty co-production would simply require approval as such by Telefilm Canada. |

This would continue to be in addition to the requirements with respect to each of the other criteria identified in PNs 1997-98 and 1999-29. The letter notes that the proposed change would be consistent with the eligibility requirements concerning access by co-productions to the Canadian Television Fund. |

Call for comments |

6. |
The Commission seeks comments on the above proposal, and will accept comments received on or before 1 December 2000. |

7. |
Although the Commission will not formally acknowledge receipt of written comments, it will give full consideration to each, and they will form part of the public file, provided that the filing procedures set out below are followed. |

Interested parties can file their comments on paper or electronically. Submissions longer than five pages should include a summary. |

9. |
Parties wishing to file their comments on paper should send them to the Secretary General, CRTC, Ottawa, K1A 0N2. |

Parties wishing to file electronic versions of their comments can do so by email or on diskette. The Commission email address is procedure@crtc.gc.ca |

Electronic submissions should be in the HTML format. As an alternative, those making submissions may use "Microsoft Word" for text and "Microsoft Excel" for spreadsheets. |

The Commission will make comments filed in electronic form available on its web site at www.crtc.gc.ca in the official language and format in which they are submitted. This will make it easier for members of the public to consult the documents. |
