  Contribution exemption for Call-Net Technology Services administrative circuits approved

The CRTC approves a contribution exemption for administrative circuits provided to Call-Net Technology Services Inc. by Bell Canada.

By letter dated 26 July 2000, Call-Net Enterprises Inc., on behalf of Call-Net Technology Services Inc. (CNTS), applied for contribution exemption for certain circuits used to test and maintain data equipment dedicated to its end-customers.

CNTS attached an affidavit including a list of circuits that are the subject of the exemption request. CNTS requested that, consistent with Telecom Public Notice CRTC 95-26, dated 12 June 1995, the effective date for the administrative circuits should be the date of installation.

By letter dated 16 August 2000, Bell Canada submitted that the affidavit in question is deficient in certain respects. Bell Canada indicated that the affidavit does not state that the circuits do not connect directly with interexchange networks provided by CNTS or another service provider that would be subject to contribution charges. Bell Canada submitted that interexchange administrative calls carried over some networks, including certain data networks, could be subject to contribution.

4. Bell Canada stated that it has reviewed the list of circuits provided by CNTS and has identified a few discrepancies. Bell Canada submitted that CNTS should be required to clarify these discrepancies prior to approval of a contribution exemption.

By letter dated 28 August 2000, CNTS provided a revised affidavit affirming that the circuits in question do not and will not connect directly with the interexchange network provided by CNTS or another service provider. In response to Bell Canada's concern that it had no record of 21 circuits, CNTS stated that 20 of their circuits were recently cancelled and therefore may not appear in active circuit records. CNTS also provided explanatory comments regarding three other circuits.

The Commission is of the view that CNTS has provided a satisfactory affidavit and approves the contribution exemption application effective the date of installation.
