CRTC approves contribution exemption for administrative and Centrex circuits used to provide local service | |

The CRTC approves a contribution exemption for administrative and local circuits provided to MaxLink Communications by Bell Canada. | |

By letter dated 30 March 2000, MaxLink Communications Inc. requested an exemption from contribution charges for administrative and Centrex public switched telephone network (PSTN) circuits. To support its application for contribution exemption of administrative circuits, MaxLink attached an affidavit attesting that: |
a) the circuits in its business offices are used strictly for administrative purposes; | |
b) these circuits do not access MaxLink's long distance network; and | |
c) all calls are routed over equal access arrangements. | |

MaxLink also requested that the exemption for the administrative circuits be granted effective the date of installation and for the Centrex circuits the date of this application. |

By letter dated 18 April 2000, Bell Canada considered that MaxLink's affidavit satisfies the evidentiary requirements for the contribution exemption with respect to administrative circuits. |

Bell Canada noted that MaxLink has not yet installed the Centrex services that would be used to provide local service and apparently is seeking advance approval of an exemption. Bell Canada agreed with MaxLink's request for advance approval of the Centrex services in question subject to MaxLink providing an additional affidavit to the Commission and Bell Canada once the first of the Centrex systems has been installed, affirming that the Centrex systems do not connect with MaxLink's interexchange network or with the network of any other interexchange service provider. |

By letter dated 10 July 2000, MaxLink provided a new affidavit which was deficient. |

By email dated 3 August 2000, MaxLink provided a list of its current services. |

By letter dated 16 August 2000, Bell Canada, after reviewing the list of current services, agreed with the exemption, subject to MaxLink issuing a revised affidavit affirming that no interexchange or local private lines are connected to the Centrex systems to permit direct access to interexchange networks provided by MaxLink or any other services provider. |

By letter dated 17 August 2000, MaxLink filed a revised affidavit which addressed Bell Canada's concerns. This affidavit was corrected by one dated 31 August 2000. |

By letter dated 8 September 2000, MaxLink placed its affidavit (less the attachment) dated 31 August 2000 on the public record. |

The Commission is of the view that MaxLink has provided a satisfactory affidavit that meets the evidentiary requirements with respect to administrative lines, and accordingly, approves this part of MaxLink's application effective the date of installation such that no contribution is payable. |

The Commission is also of the view that MaxLink has provided a satisfactory affidavit dated 31 August 2000 that meets the evidentiary requirements with respect to local services. It accordingly approves this part of MaxLink's application effective the date of installation such that no contribution is payable. |
