Contribution exemption for administrative and Centrex circuits used to provide local service

By letter dated 30 March 2000, MaxLink Communications Inc. requested an exemption from contribution charges for administrative and Centrex public-switched telephone network (PSTN) circuits. The Commission grants approval subject to certain conditions.

To support its application for contribution exemption of administrative circuits, MaxLink attached an affidavit attesting that a) the circuits in their business offices are used strictly for administrative purposes; b) these circuits do not access MaxLink's long distance network; and c) all calls are routed over equal access arrangements.

MaxLink also requested that the exemption for the administrative circuits be granted effective the date of installation, and for the Centrex circuits on the date of this application.

By letter dated 20 April 2000, TELUS Communications Inc. (TCI) considered that MaxLink's affidavit satisfies the requirements for the contribution exemption with respect to administrative circuits. TCI also agreed with MaxLink's request that the effective date for the administrative circuits be the installation date is consistent with Effective date of contribution exemptions , Telecom Public Notice CRTC 95-26, dated 12 June 1995.

With respect to MaxLink's application for exemption from contribution for its Centrex PSTN connections, TCI noted that MaxLink relied upon Telecom Order CRTC 97-1155. TCI submitted that the correct order reference should have been Telecom Order CRTC 97-1555, dated 23 October 1997. MaxLink submitted that, once the first of the Centrex lines has been installed by TCI, MaxLink should file an affidavit affirming that a) the Centrex services in question are for use by MaxLink to provide local services to its end-customers; and b) there are no direct private line connections from the Centrex system to the interexchange network of MaxLink or any affiliated company.

TCI submitted that MaxLink's approach is consistent with Order 97-1555 and appropriate in this case. TCI also agreed that in accordance with Applications for contribution exemptions , Telecom Decision CRTC 93-2, dated 1 April 1993, the exemption for the Centrex circuits at issue should be effective the date of MaxLink's application.

The Commission is of the view that MaxLink has provided a satisfactory affidavit that meets the evidentiary requirements with respect to administrative lines. It therefore approves this part of MaxLink's application effective the date of installation such that no contribution is payable.

The Commission is of the view that MaxLink is requesting advance approval of an exemption with respect to Centrex services that it will use to provide local services only to its customers. The Commission grants advance approval to MaxLink for the circuits in question effective the date of installation such that no contribution is payable. Approval is subject to the requirement that MaxLink provide an additional affidavit (affirming that the Centrex services are used to provide local service only to its end-customers and do not connect with MaxLink's interexchange network or with the network of any other interexchange service provider) to the Commission and to TCI once the first of the Centrex systems has been installed.
