  TCBC payphone card promotion approved on a final basis

TELUS Communications (B.C.) Inc.'s payphone card promotion received interim approval in Order 99-1171. The Commission now approves the proposal on a final basis.

In Telecom Order CRTC 99-1171, the Commission approved, on an interim basis, TCBC's proposal to introduce a payphone card promotion.

The Commission received comments from Canada Payphone Corporation (CPC) and the Canadian Payphone Association (CPA).

The interveners submitted that the proposal constituted unfair competition with the newly emerging competitive pay telephone service providers.

CPC submitted that since the cards are designed to work exclusively in TCBC's payphone products, they represent an undue advantage to the telephone company. Accordingly, CPC asked that, if the Commission should approve this proposal, it should make it conditional on an effective interoperability arrangement.

TCBC replied that the intent of the proposed promotion in TN 4016 was to increase awareness and interest in the company's payphone card. Contrary to CPC's and CPA's claim, it is not anti-competitive. The promotion is a legitimate offering of limited duration and consistent with the Commission's rules regarding such promotions.

The Commission considers that the payphone card issued by TCBC, that is proprietary to the company's payphones, does not confer an undue advantage on the company.

7.

The Commission considers that TCBC's proposal meets the criteria for a limited short-term promotion which does not require an imputation test.
