Summary
The Commission approves the applications by the CBC to convert CBF-FM-10 Sherbrooke and CBF-FM-8 Trois-Rivières to French-language FM radio programming undertakings broadcasting regional programming. These stations currently retransmit the programming of CBF-FM Montréal in its entirety. The CBC also proposed to retransmit the programming of the new Sherbrooke station on CBF-FM-11 Asbestos, CBF-FM-6 Lac Mégantic and CBF-FM-12 Victoriaville, rather than the programming of CBF-FM Montréal.
Decision

The Commission approves the application by the Canadian Broadcasting Corporation (CBC) for a licence to carry on a French-language FM radio programming undertaking at Sherbrooke, on the frequency 101.1 MHz (channel 266B) with an effective radiated power of 35,000 watts. The licence for the new station will include the authority for the transmitters CBF-FM-6 Lac Mégantic, CBF-FM-11 Asbestos and CBF-FM-12 Victoriaville.

The Commission also approves the application to carry on a French-language FM radio programming undertaking at Trois-Rivières. The new station will operate on the frequency 88.1 MHz (channel 201B) with an effective radiated power of 4,326 watts.

The Commission therefore approves the application by the CBC to amend the licence for CBF-FM Montréal by deleting the authority for the transmitters CBF-FM-6 Lac Mégantic, CBF-FM-8 Trois-Rivières, CBF-FM-10 Sherbrooke, CBF-FM-11 Asbestos and CBF-FM-12 Victoriaville.

The Sherbrooke station will broadcast a minimum of 6 hours 15 minutes a week of regional programming, and the Trois-Rivières station, a minimum of 5 hours. Regional programming will focus on daily regional news, including economic, political, social and cultural issues. For the remainder of the broadcast day, the new stations will retransmit the programming of CBF-FM Montréal.
Conditions of licence

Each licence is subject to the conditions specified in the licence to be issued. Further, as conditions of licence, the licensee must:
  • not broadcast any commercial message of category 5 except

a) during programs that are available to the network only on a sponsored basis, or

b) as required to fulfill the requirements of the legislation of the Parliament of Canada pertaining to elections;

  • ensure that 50% or more of the category 2 music selections broadcast each broadcast month be Canadian;
  • ensure that 20% or more of the category 3 music selections broadcast each broadcast month be Canadian and that these selections be scheduled in a reasonable manner throughout the broadcast day;
  • adhere to its self-regulatory guidelines on sex-role portrayal as amended from time to time and approved by the Commission, and, as a minimum, to the Canadian Association of Broadcasters’ Sex-Role Portrayal Code for Television and Radio Programming, as amended from time to time and approved by the Commission.
For the purpose of these conditions of licence, the term "broadcast month" shall have the same meaning as that set out in section 2 of the Television Broadcasting Regulations, 1987.
