Licence renewal for CKDX-FM

The Commission renews the broadcasting licence for CKDX-FM Newmarket from 1 March 2000 to 31 August 2003, subject to the conditions specified in the licence to be issued. The Commission has renewed the licence for a short term because it wishes to assess at an early date the licensee's compliance with the Radio Regulations, 1986 (the regulations).

Section 8 of the regulations requires licensees to keep for a period of up to four weeks from the date of broadcast, "a clear and intelligible tape recording" of the programming broadcast, and to provide it to the Commission upon request. The Commission requested the logger tapes and music lists for the programming broadcast by CKDX-FM during the week of 4 to 10 May 1997. The tapes for the entire week were unintelligible.

At the time, section 2 of the regulations required that at least 30% of all popular music selections (category 2) broadcast each week be Canadian. The licensee's self-assessment report for the week in question indicated that only 27.4% of the popular music broadcast by CKDX-FM during that period qualified as Canadian.

In a letter to the Commission dated 20 March 1998, the licensee described the steps it had taken to ensure compliance with the regulations. The licensee has installed an additional VHS logger unit that runs simultaneously with the original reel-to-reel logger system. In its music logs, the licensee now designates Canadian content selections with a "C" in a separate column. All on-air staff now consult relevant music trade publications for Canadian content information and meet regularly with the station's music director. The Commission is satisfied with the measures taken by the licensee.

During the new licence term, the licensee must offer a higher level of Canadian popular music because the regulations now require that at least 35% of all musical selections broadcast each week from category 2 be Canadian.

The Canadian Independent Record Production Association filed an intervention expressing concern regarding the licensee's failure to comply with the regulatory requirement for Canadian content. The licensee replied that CKDX-FM currently broadcasts at least 38% Canadian content. The Commission is satisfied with the licensee's response.

In Public Notice CRTC 1992-59 dated 1 September 1992 and entitled Implementation of an Employment Equity Policy, the Commission announced that the employment equity practices of broadcasters would be subject to examination by the Commission. In this regard, the Commission encourages the licensee to consider employment equity issues in its hiring practices and in all other aspects of its management of human resources.
