Addition of conditions to the licence for CJYQ

1.

The Commission approves the application to amend the broadcasting licence for CJYQ St. John's. By conditions of licence, the licensee shall:

  • broadcast, as an exception to the percentage of Canadian musical selections set out in the Radio Regulations, 1986, a minimum Canadian content level of 40% in Category 2 (popular) musical selections during the broadcast week and during the period between the hours of 6:00 a.m. and 6:00 p.m. throughout the broadcast week;
  • broadcast Newfoundland musical selections representing a minimum of 20% of all Category 2 musical selections aired during the broadcast week and during the period between the hours of 6:00 a.m. and 6:00 p.m. throughout the broadcast week;
  • produce and distribute during each broadcast week, eight hours of Newfoundland-based programming for broadcast on each of the stations acquired from Radio VOCM; and
  • expend a minimum of $100,000 over seven years on the production of compact discs and demonstration recordings to assist artists specializing in the performance of traditional Newfoundland music.
This additional direct expenditure is over and above existing commitments offered in accordance with the Canadian Association of Broadcasters' Distribution guidelines for Canadian talent development and commitments to Canadian talent development accepted as part of Newcap's benefits package outlined in Decision CRTC 2000-141.
For the purpose of these conditions, a Newfoundland musical selection is one either produced in Newfoundland or produced by someone from the province; and a Newfoundland artist is one born in Newfoundland or who has been residing in the province for more than 12 months.

Newcap has indicated that its Newfoundland-based programming will consist of a mix of Newfoundland musical selections as defined above, together with comedy, artist interviews and plays.

In Decision 2000-141, the Commission approved Newcap's acquisition of the radio stations in Newfoundland owned by VOCM Radio, with the condition that the licensee submit an application, within 90 days of the date of the decision, formally requesting the addition of the conditions of licence noted above.
