Decrease in power for CJYC-FM

1.

The Commission approves the application by Maritime Broadcasting System Limited (Maritime) to decrease the effective radiated power of CJYC-FM Saint John, from 50,000 watts to 12,000 watts.

The licensee also proposes to increase the effective height of its transmitting tower and relocate it from Sandy Point to Mount Champlain. Commission approval is not required for these changes. The former owner of CJYC-FM (Newcap Inc.) submitted an application for a similar relocation of the transmitter to Mount Champlain and a decrease of the effective radiated power to 8,200 watts. That application was approved in Decision CRTC 97-639, but never implemented.

In support of its application, Maritime stated that the proposed change would not result in any change to its marketing or financial operations, and would provide a better quality signal to Saint John.

An intervention in opposition to the application was submitted jointly by Radio One Ltd. (Radio One) former licensee of CIHI/CKHJ-FM Fredericton and Radio Atlantic (CIBX) Ltd. (Radio Atlantic), former licensee of CIBX-FM Fredericton. (After the filing of the intervention, the assets of both Radio One and Radio Atlantic were sold to Telemedia Communications Inc.)

The interveners expressed concern that Maritime's proposal would result in the signal of CJYC-FM becoming competitive in the Fredericton market. The interveners requested that Maritime be prevented from soliciting advertising from the Fredericton market, and/or required to direct the proposed signal away from Fredericton. The interveners argued that approval of the application as submitted could result in a serious negative impact for existing Fredericton radio broadcasters.

In response to the intervention, Maritime stated that Fredericton is not currently served with CJYC-FM's classic rock radio format that would appeal to many students in such a university city.

The Commission has considered the positions of both the applicant and the interveners, and is satisfied that the recent consolidation of radio station ownership in the Fredericton market will ensure that no undue negative impact on an existing licensee will result from the approval of this application.

The Department of Industry has advised the Commission that this application is conditionally technically acceptable. The Department will only issue a Broadcasting Certificate once it has determined that the proposed technical parameters will not create any unacceptable interference with aeronautical NAV/COM services.

In accordance with section 22(1) of the Broadcasting Act, the above-mentioned amendment will only be valid when the Department of Industry certifies to the Commission that its technical requirements have been met and that a broadcasting certificate has been or will be issued.
